If they find the CM is right, a simple apology is in order for the accidental hit and move on. If the guest is right, then some sort of punishment and an apology is in order.
- The family is going to seek money damages
- Tigger is claiming that the kid "grabbed the back of his costume, cutting off the air to him......." (eat that all those who say the CM can't/won't talk out)
- The union is claiming an accidental hit (ie, Tigger couldn't see he was going to hit the kid)
- The family is bringing in a witness that will provide a different take on the cause for the hit
And you were proven wrong... they did want green Ben Franklins.
I didn't think about his limited vision in the costume..so I guess you are right it really is a lose lose situation.. I know my dad would have beat me black and blue if I had ever done anything to provoke a Disney Character like that

The Parents were police Officers for 10 years prior to getting a JD. Grandad was a chief and so was great grandpa. I have had numerous uncle's and cousins that were LE as well. Interesting enough is that mom was the only female to do it.
Again though, regardless of what the kid may or may not have done, the Union is saying that the actual hit itself was caused by bad vision in the costume (Which in my book means 'accidental'). They aren't saying he hit him to get him off (which would be 'self-defense'). How he got into that situation is an entirely different story, one that I am not talking about at the moment.

Actually, that report was made SUNDAY NIGHT, they spent SATURDAY NIGHT at the hospital. The incident happened at 12:30 FRIDAY AFTERNOON.
That's more than 9 1/2 hours. And a LOT of actions that could have caused it.

Union Rep Says Tigger Was Trying To Escape From Teen
ORLANDO, Fla. (WFTV.com) – A New Hampshire teenager said home video proves he was attacked by Tigger at Disney-MGM Studios. But, Channel 9 has learned Tigger said he was the one who was at-tacked. A union representative for him said he was pulled and was choking, adding he was just trying to escape. In the video, Jerry Monaco, Jr., looks as if he's using his left arm to get closer to Tigger to pose for a picture. Then, the video shows Tigger's arm go for the teen, appearing as though Tigger is hitting him. But the man in the Tigger suit, Michael Fedelem, said through his union representative that he was the victim. Jerry Monaco, Jr., 14, said he did nothing to provoke Tigger. The teen's father filed charges against Fedelem with the Orange County Sheriff's Office and Fedelem was suspended from work by Disney for now. The father thinks Tigger was annoyed that he was abandoned by his character escort. But Donna-Lynne Dalton, who represents more than 2,000 characters at Disney, has a different take. ....
Is the CM suspended with or without pay? If I were him, I'd sue the family for back pay if it is without pay, then I would sue for pain and suffering and libel.

The only suit is filed against Disney. Disney usually wins thier cases, or settles out of court.
There aren't any charges filed against the CM according to the public files. I hope it stays that way.
Judging strictly on public opinion on both Disney and non-Disney related sites the Monaco family does not have a snowball's chance in hades of winning this case.so who will win this case?
