Disney can use Marvel characters that Universal has not used in their theme parks, so.................... We could see Iron Man, Captain America, Gardians of The Galaxy, and Thor at WDW. Also if Uni fails to keep their Marvel Rides in good condition Disney get the rights.
3/4 characters you mentioned are represented in Marvel Superhero Island.

Actually, Captain America, Iron Man and Thor are all forbidden from being used in WDW because they are all Avengers and are within the same family as the Hulk and Spider-Man.

Nope... Many of those are Avengers as others have said. Some are already represented in the parks, and others would be classified as part of the Avengers family of characters, which would also be prohibited from use by Disney under the terms of the Marvel-Universal contract. It is not just the characters actually present now but also includes their "character families." Please read the contract. It spells it out quite nicely and avoids intelligent people like yourself being made to look the fool. The only group Disney could maybe get away with is Guardians of the Galaxy.

And yes the rights could revert if Universal stopped taking care of their rides... but they haven't. They take care of their rides better than Disney does for the most part, at least at this juncture in time. And it appears they will be doing so for a long time going forward based on the updates they do to their rides as well as the way they have cleaned up their parks in the past few years.

Well, technically, Disney can build anything Marvel it wants in any of its Orlando parks provided that the character(s), or the "families" of those characters, used by Disney are not already used in a more than incidental manner by Universal.

Disney could try and establish a precedent to see just how much it can get away with in regard to meet & greets or hotels or restaurants outside the parks too, but why would they want to give essentially free advertising for the competitors park up the street? I can't think of a more effective way to get more WDW resort guests to head up I-4 than that.

The only semi-practical way I can imagine WDW ever getting (limited) Marvel rights (and lets be clear - its not going to happen - purely an academic discussion) is to make a deal with Universal. As others noted previously in this thread, buying Universal out would be hilariously expensive, so that's out of the question. But, if you could get Universal to sign off on it, maybe you could get an agreement to use some obscure "family" characters which aren't closely connected to the Avengers or other heroes represented at IOA. But again - why, why, why would you want to spend millions building an attraction around a largely unknown superhero which is naturally and obviously going to invite quite unfavorable (if not mocking) comparisons with the well-known characters in Universal's camp.

This is indeed a rather pointless discussion. Nothing wrong with talking about it for those who want to, I suppose, just no point to it. We may as well discuss bringing back Timekeeper to the MK - this time with real time travel.
This could totally work. A contract can always be renegotiated, but the ideal time to do it probably would have been before they announced the second phase of the Marvel Cinematic Universe/parts of phase 3. Disney and Comcast probably have more lawyers than they even know what to do with; lock them in a room and let them fight over a deal. I could see it hypothetically going three ways:

1. Disney is willing to straight up pay for a list of smaller characters that are not directly used at Uni. They could have grabbed rights to characters like Ant-Man or Black Panther that probably wouldn't mean much to Uni, and then worked to build those characters. All of a sudden, Ant-Man has a standalone movie coming out after Avengers 2. Three years ago, even with Marvel having success, his theme park rights were pretty worthless I'd bet. Three years from today, if his movie is a success...?
2. Disney's lawyers come up with a list of characters that they think they can legally use, and they offer Uni x amount of money not to sue them. Maybe the Guardians of the Galaxy are in this group (my speculation).
3. Some combination of 1 & 2.

What Disney WON'T do, however, is strongarm Uni. I just don't see a lot of leverage for Disney in the contract. Even if Disney built a standalone E-ticket in Downtown Disney, I think they'd be in court for years.

Disney would have to allow themselves to be ripped off by Uni in a buyout. Uni has all the leverage since they are content and have the rights... Disney wants them but can't have them.

They are actually re-touching the land at the moment, some of the superheroes have been taken down for refurbishment, pretty sure the land got re-painted as a whole not too long ago, Spider-Man was redone in complete HD, etc.

I think to help increase the strength of Marvel Super Hero Island they could actually add some theming elements to the last part of Hulk, particularily to help hide some of the backstage views of Port of Entry.

Don't forget, the costume characters have received brand new, updated uniforms within the last 2 years as well... The land looks great.. Never looked better in my opinion...

That's the dumb part of the contract. Literally SOOOO many marvel characters are part of the avengers in some way shape or form! it sucks

I definitely think Disney COULD do a better job representing them in the parks!....however in recent years there attractions have not been up to par you could say so if things don't change, I want UNI to keep them!
