You are correct, but the issue is a bit complicated. Most juries would find that the CM would be primarily responsible for the incident, and that Disney's culpability would be small. However, under the system of "joint and several liability," a plaintiff would only have show that Disney shares some responsibility in the matter, however small (even 1%), to put Disney on the hook for all damages. So in practical terms, companies are fully liable for all the actions of their employees, at least in states with joint liability. More and more states are reforming tort law in an effort to avoid situations like this, where employers have little chance to avoid liability no matter how dedicated they are to safety.

If Disney caves to any financial settlement because of this, I'd be really disappointed.

True story. A family was apprehended by Disney plain clothes security, because the parents spent their day filling their bags with stuff from the stores they didn't pay for. They had two young children with them. They were taken to a backstage security office, which is where they get transferred to the local police authority. The family actually sued Disney, because while being taken to the paddy waggon, their kids saw some characters without their heads on.

I've watched the video twice and it is perfectly apparent that a certain 14 year old was fooling around and he got off very lightly with a defensive push.​

Tigger was defending himself from an unprovoked attack from the rear and was in danger of losing his head and you clearly see the front of his face/chin rising very rapidly as he becomes aware of the assault. The 14 year old lad had hold of the back of the costume and you don't need a degree in rocket science to see what was occurring.​

This father and son need a dose of reality powder and I have to ask........ wheres the rest of the family...... conspicuous by their absense or what !!!!!!!!!​

Come on CEO of Disney MGM .......... the world says Tigger is innocent. Listen to the world and don't pander to these money grabbing so and so's​

The real question would be did they win?

I guarantee any of us here could call one of the local ambulance chasers and get a suit filed against Disney before the end of business tomorrow. All of us remember the "Hydrolator ruptured my eardrum" and "A stone fell from the castle and hit me in the head" cases that went all the way to court before being thrown out.

We need to have our court system changed so people won't even be able to try to sue for crap like this. If anyone should be suing, it's Disney. I hope they do and make this stupid family learn a lesson. This is pathetic. I hope the CM is given his job back and with a bonus (Given the money he would be making during the time of this suspension). I don't think he should be transfered, unless if he wants to be.

I think this family should get some sort of punishment, perferably federal punishment for waisting everyone's time. These sue happy people need to get what they have coming to them. After they get what they have coming, our court system needs to change their lawsuit guidelines. This is absolutely pathetic and I hope Disney gains something off of this.

And just one more thing from personal experience. I know this is totally judging by looks, but look at what the kid is wearing. Who wears biker gloves to a park, and look at the smirk on his face. He was trying something, i've seen that same smirk before and next thing you know BAM, I would get a smack in the face or a kick.


It won't matter...the CM is toast.
 
I just hope this family's fifteen minutes of fame will be up soon and they will enjoy the free trip back to WDW that I'm sure they got with all the bells and whistles included. Its ridiculous that this is even news, IMHO


I hope they DON"T enjoy their free trip. I hope all the lines are 2 hours or more, the counter service is swamped, they lose their camera, the whole family gets sick on everest, their room is the farthest from the bus stop, and all their favorite rides are down for rehab.

As I see it, the CM was defending a major and sacred asset of the Disney Company and should receive a promotion. I would imagine that CMs are literally blind-sided while in one of those costumes and when the CM felt someone tampering with his costume, he turned to protect it and, in doing so, accidentally brushed the boy's face. I also have to imagine that removal of part of the costume while in a guest area, intentionally or otherwise, must be a mortal sin to the Disney Company and part of the inculcation provided to the employees.

The CM's job and reputation are on the line and, unless he just decided to belt this kid for the hell of it, he's the only party that has been damaged in this incident. I feel real bad for this guy for being put in an untenable situation.. We can all make claims about how he could've reacted or how we would've reacted but, truth be told, he acted with a great deal of restraint and prudence considering the consequences if that kid was somehow able to unzip the skin or tip the costume head off the CM.

That's what I want to know. I mean to me there is no question that Tigger is acting out of some kind of self defense. I really doubt he would risk his job to just randomly smack someone like that.

Don't they have handlers with them to step in in situations where someone is messing with them like that?

It just makes me wonder because you never see the handler in the clips that I have seen on TV.

1. It strikes me that the hit is unintentional. I doubt the character has good peripheral vision so as to be able to line up a direct hit on this kid's face. If the hit was intentional and he was reacting to something the kid said, rather than did, the character is in the wrong. If what he did was react to something the kid was doing physically then my guess is that it was reasonable.

2. Even if you assume that the character is completely in the wrong, the behaviour of the family is bizarre. First of all, the kid's dignity is absolutely shot. He'll now FOREVER be known by his friends and high school as the kid who got hit by Tigger. He'll be a joke. Even if the kid was an innocent victim, his father just magnified his victim status a hundred fold.

3. It seems bizarre that the father would comment that its been a blur since Friday when HE is the one who turned over the video to the local news station and then found a way to engage a lawyer and found a way to get himself booked on the CBS morning news.

4. People always say that all they want is an apology, then they try to use the apology as an admission of the other party. Get the release signed first...

There are exseptions to every rule. I don't see Disney being legally resposable in this case. That doesn't mean that people don't sue for that kind of thing all the time, and it certainly doesn't mean that the company won't pay to settle it out of court.

Let them sue. Disney has a long and well earned reputation for fighting nuisance lawsuits and not settling out of court. Their lawyers will tie these people up in court for years.

Well if you really want to complain to someone my guess would be to direct your feelings to Michael O’Grattan the VP of the Disney-MGM Studios. I am sure the Disney Operator can connect you to his voice mail box.

The punk is obviously trying something behind the BIg 'T's" Back. And we only have ones side of the story. howcome tigger has not com fourth with a statement. I beleive these are sue happy people and Tigger did nothing wrong. It appears as if the kid was tampering or attempting to tamper with something.

I hope the CM walks away from this with this with a fat civil suit judgement against the Monaco family. Out off the people claiming to be victim the only real victim I see here is the CM that is now on suspension without pay because some punk thought he could be funny.


I so agree with you!!! The only thing is WDW encourages CM's not to press charges (especially the characters when they are assaulted). They think that might upset the guests. I wonder what would happen if Bob Iger or Jay Rasulo were walking in the parks and out of no where someone came up and tackled them and beat the living daylights out of them. Now would they just go on as normal and act like everything is ok?? We know the answer to that and it would be NO! I know that's a little off topic but I think the CM should go after them and if the only way to do that is filing a Civil Lawsuit I say more power to him.

notice also that when the kid is in the interview he shakes and has to think about a good lie to come up with. He didnt realize this would be on the news
