Military planes to fly over Disney

The New York Times reports that to address general New Year's Eve security concerns, military planes will be flying over Walt Disney World, as well as Washington D.C., New York City, Las Vegas and Chicago this evening.


The airspace over Disney has been off limits to any chartered or leisure aircraft since March 18 due to terrorism concerns.

The Times reports that the military jets will be supported by what is described as an "extraordinary deployment" of law enforcement personnel on the ground in major cities.

The national terrorism alert remains "Code Orange," the second-highest level of the terrorism advisory system.

Thats really dumb at least over Disney. I mean, did Eisner agree to this or was it a forced decision? Disney is supposed to be a carefree place. Will there also be ground troops at WDW? DL? Any terrorist who tries to get any amusement park is stupid...Just go on TOT. I bet its more fun than dieing.

I think it's good to have planes over the parks. Disney *needs* all the safety it can get.

If you want it to be a carefree place, you want it to be safe.

It's not like pamphlets are being handed out saying "due to code orange. . . " After all, the sounds of planes have been heard all year.

Really dumb? Hundreds of thousands of people gathering in on place sounds like a prime target for a terrorist. Let's see how dumb that idea is when a hijacked 747 goes barreling into Cinderella's castle. I'd feel a lot more comfortable having F-16's protecting me.

Just to LEASE a half way decent chopper a year is close to a Million bucks... jeeze... imagine how much ticket prices & hotel rooms $$$ would go up then :lol: :hammer: :brick:

Disney does have their own planes and helicopters. Just not for security. Overall I think the military is the best in these type of situations.

Being a safe and happy place is what those with 'evil' on their minds want you to believe. Therefore, I personally think its a GREAT idea...better to be safe....than sorry in the worst possible way. Let them do thier job, I am sure its not like they are going to be buzzing the parks...you probably wont even notice them...Happy New Year!:king:

What no one realizes is that Cinderella Castle is a missile silo. At a moments notice, the top one-third is blown clear and a nuclear tipped warhead is lifted into place. This alteration was done in secrecy during the 25th anniversary of WDW while the castle was covered by the birthday cake. I don't blame the military one iota for wanting to protect it's assets, do you?:rolleyes:

Yes, WDW is a carefree place. That's why no one will see or hear the warplanes overhead tonight. They will stand clear of the area by several miles, a distance that can be covered in a fraction of time if called upon. I'm sure they'e not going to buzz the parks like Rodan buzzed Tokyo!

Godspeed to all the guys & gals vigilantly on duty across the country and world tonight assuring the safety of freedom loving people everywhere, something many souls will never fully appreciate.:sohappy:

Is it me, or do some people seem (almost) afraid of the military handling our security? I mean, come on, you'd rather have Disney Staff handle security, than to have the full weight/protection of the U.S. Military?

Am I missing something here? Or is this more of the conspiracy crowd?

Protecting WDW with U.S. military aircraft sounds like a violation of United States Law to me. To wit:

USC TITLE 18 > PART I > CHAPTER 67 > Sec. 1385. |
Sec. 1385. - Use of Army and Air Force as posse comitatus

Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army or the Air Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both.

Well, I'd like to explain in more detail but that would require that I delve into the politics of the issue. I can't provide more information without violating Eeyore's no political discussion directive. So, I'll leave this one alone. Suffice it to say that the Homeland Security Act of 2002 does not supercede USC TITLE 18 > PART I > CHAPTER 67 > Sec. 1385. That would be unconstitutional.

Here is the section of the Homeland Security Act of 2002 that applies to this situation:

Section 304. Military activities.

This section clarifies that nothing in the bill confers upon the Secretary of Homeland Security any authority to engage in warfighting, the military defense of the United States, or other traditional military activities.

Well, sort of. But not quite.

Posse comitatus literally means "power of the county," the authority given historically to draw a legal posse to aid in enforcement of local laws or apprehension of dangerous criminals. The USC section was originally passed to put an end to use of the Army to maintain civil order after the Civil War, but later was amended to ensure that the U.S. military would not be used to support civilian law enforcement, unless accorded by law.

There's the flaw in your argument. Federal airspace is just that, under federal jurisdiction. Federal. Not civilian. Use of military forces to ensure security of federally maintained airspace is not a violation of Title 18 USC P1 CH67.

just having a chance to step in my office here....

anyways, i'm not an expert, but wouldn't the circling fighters be part of an air national guard wing? would that be directed at the federal level or state level in that case?

To my understanding, the forces of the National Guard (including air) and the Coast Guard are except from previous stated USC section. The National Guard is enacted by the states, under control of the governor, and the Coast Guard is under the Department of Transportation, and not under the umbrella of the Department of Defense.

The information posted in this thread doesn't indicate it, but since it involves multiple cities in different states, I would lean towards Air Force aircraft in the air. But who knows? Air Guard could be up there, as well.
