The Eighth Amendment protects against excessive fines. A $100,000 fine for a gathering at your home seems prima facie excessive.

Although one would think this is the case (which is to say, I agree with you), the courts and state legislatures have not agreed. Fines of similar magnitude for similar (or less) offenses exist in most of the country without constitutional challenge.

Thanks to rowrbazzle as well! I was unaware of the purpose of the eighth amendment. $100,000 dollars does seem like a huge fine, about 75000 USA dollars. I could imagine a scenario where the house owner was unaware as children organised the gathering which would cause huge difficulties. However the government must believe it is an effective and enforceable disincentive!

people would be quite surprised to know how much power both the federal and state governments have in a public health emergency

Interesting. I know there have been more push-backs in recent years over things like (excessive) civil forfeiture. It seems like an approach that is changing lately. The law rarely seems to be in a hurry.

I honestly debated whether or not to include the bit about the Constitution. I probably should've left it off, as my main point was that I can't see such a law being implemented right now. Anywho...

Wait, I just turned the graph upside down. Ok, it’s falling now.
Deaths lag cases. Cases are falling. Deaths will fall in concert. Luckily, the southern states learned lessons from us elites in the northeast, and have severely mitigated the deaths.

You really have a great way of spinning things. I should have known better but I just expect better from you. Nothing is clearly going down, and you know that.
That’s not two days. It’s a week. I’m not spinning anything. Feel free to dig into the data. Hospitalizations, cases, positivity, all falling.

I understand that, but I mainly referring to deaths that are rising, which for a long time was the crutch many people's arguments. Its certainly nice to see cases slightly dip but nothing is clearly going in a downward trend. Also, as far as cases go, that "dip" is today's date, not all data has been submitted for today's date and tomorrow's date.

Not a great start to the MLB season:


It‘s tough to have the players out in the community especially in Miami or Atlanta (last 2 places the team went) where there’s a hot spot. On a selfish note, can we get these guys put of Philly before they start spreading infection locally ;)

Lets hope the start to the school year lasts longer than the start to the Marlins season.

Weeks ago you were lamenting the lack.
Weeks ago you were saying cases weren’t that bad. Then they went up and you said it’s the percent positive.. then that shot up .. then it was deaths are low those because it’s just younger people being infected. Now that’s up.. now your back to cases dropping and deaths are lagging. I can see how you never think your wrong.

Seems like a good solution. Made no sense to have two bystander teams both sitting not playing, while in the same division.

Hopefully the Phillies continue to test negative and the Marlins, well, it looks like we'll see their AAA team soon.
