Here’s the real story. Nothing was mentioned about breaking the company up. The investor suggested DIS forego their dividend and use the cash to invest in streaming content. They also suggested that Disney consider bringing more or their blockbusters straight to streaming. It even notes in here that the tone in the letter sent to Disney was more supportive than typical activist investor activity. Nothing I’ve seen suggests or even hints at a request to break up the company.

Individual businesses still have the right to cap capacity, require masks and require distancing. This just opens the door for them to legally not do those things. I would be more concerned with college football games. The concept when the season resumed was to have games with limited capacity, distancing and masks with no tailgates. This opens the door wide open for full attendance, no enforcement of masks and full tailgates.
Investors seemed fine with Disney investing money in streaming services. I don’t think this changes anything really. If anything it pushes them further towards the streaming business over traditional network and cable TV but that was coming anyway. If you lose some income funds that invest more heavily in dividend paying stocks you gain ones that invest more heavily in growth stocks it’s a wash. There’s no indication this would have any bearing on the parks either.

Easier to enforce with lower capacity. Once there’s a full stadium its next to impossible to enforce and certainly not at tailgates. Having all those people mixed together without any distancing and with partial mask compliance could be a recipe for disaster. One of these games could very well be the story talked about 100 years from now like the Philadelphia parade during the Spanish Flu pandemic that led to a major outbreak.
