It's common sense to yield to the larger vehicle, especially on water ... but of course some lawyer will convince them they have a case and they will file charges. WOW, how stupid can you be.

BTW,

A woman got killed back in the 80's when her sea ray hit the ferry taking her underneath.

Her passenger son survived though.

Based on the location given in that article we are not looking at one of the 2 huge ferry boats on the 7 Seas Lagoon but one of the pontoon ferry boats used by PORS, POFQ, etc.
When I read the first article I was under the impression they rented it from the place at the Contemporary and were out in Bay Lake/7 seas lagoon but obviously that's not the case, and like Raven said I have never seen two adults in a sea racer, an adult and a small child yeah, but 2 adults, no!
 
Hate to say it, but it sounds like they need the breathalyzer test before handing out the keys, or one on the boat to even start it. I agree with the previous poster about natural selection, but it probably should have been the husband not the wife.. I feel sorry for her.. :(

That guys comment sounds like he was loaded, if not, definitely impaired.

The Couple of the Personal Watercraft, they rented from the resort, can not sue the resort as stated in florida law.

Flordia Law CHAPTER 2000-362 Committee Substitute for Committee Substitute for Senate Bill No. 386 said:
Section 6. Effective October 1, 2000, subsections (1) and (2) of section
327.33, Florida Statutes, are amended to read:

327.33 Reckless or careless operation of vessel.—

(1) It is unlawful to operate a vessel in a reckless manner. A person is
guilty of reckless operation of a vessel who operates any vessel, or manipulates
any water skis, aquaplane, or similar device, in willful or wanton
disregard for the safety of persons or property at a speed or in a manner as
to endanger, or likely to endanger, life or limb, or damage the property of,
or injure any person. Reckless operation of a vessel includes, but is not
limited to, a violation of s. 327.331(6). Any person who violates a provision
of this subsection commits a misdemeanor of the first degree,
punishable as provided in s. 775.082 or s. 775.083.

(2) Any person operating a vessel upon the waters of this state shall
operate the vessel in a reasonable and prudent manner, having regard for
other waterborne traffic, posted speed and wake restrictions, and all other attendant circumstances
so as not to endanger the life, limb, or property of any person. The failure to operate a vessel in a manner described in this
subsection constitutes careless operation. However, vessel wake and shoreline
wash resulting from the reasonable and prudent operation of a vessel
shall, absent negligence, not constitute damage or endangerment to property.
Any person who violates the provisions of this subsection commits a noncriminal violation as defined in s. 775.08.

The article did say that there are charges pending against the husband. Hopefully that happens and will discourage them from trying to sue Disney.

section 327.39, Florida Statutes, are amended to read:

327.39 Personal watercraft regulated.—
(1) A person may not operate a personal watercraft unless each person
riding on or being towed behind such vessel is wearing a type I, type II, type
III, or type V personal flotation device, other than an inflatable device,
approved by the United States Coast Guard.

(4) A personal watercraft must at all times be operated in a reasonable
and prudent manner. Maneuvers which unreasonably or unnecessarily endanger
life, limb, or property, including, but not limited to, weaving through
congested vessel traffic, jumping the wake of another vessel unreasonably
or unnecessarily close to such other vessel or when visibility around such
other vessel is obstructed, and swerving at the last possible moment to avoid
collision shall constitute reckless operation of a vessel, as provided in s.
327.33(1). Any person operating a personal watercraft must comply with the
provisions of s. 327.33.

(5) No person under the age of 14 shall operate any a personal watercraft
on the waters of this state.

(6)(a) It is unlawful for the owner of any personal watercraft or any
person having charge over or control of a personal watercraft to authorize
or knowingly permit the same to be operated by a person under 14 years of
age in violation of this section.

(b)1. It is unlawful for the owner of any leased, hired, or rented personal
watercraft, or any person having charge over or control of a leased, hired,
or rented personal watercraft, to authorize or knowingly permit the watercraft
to be operated by any person who has not received instruction in the
safe handling of personal watercraft, in compliance with rules established
by the commission.

2. Any person receiving instruction in the safe handling of personal watercraft
pursuant to a program established by rule of the commission must
provide the owner of, or person having charge of or control over, a leased,
hired, or rented personal watercraft with a written statement attesting to
the same.

3. The commission shall have the authority to establish rules pursuant
to chapter 120 prescribing the instruction to be given, which shall take into
account the nature and operational characteristics of personal watercraft
and general principles and regulations pertaining to boating safety.

(c) Any person who violates this subsection commits a
misdemeanor of the second degree, punishable as provided in s. 775.082 or
s. 775.083.

Police Report: "At this time Michael turned sharp to the right to avoid the ferry but it was too late and the ferry ran up onto the passenger side of the small boat"

Now look at what i put in bold in the florida law.

Florida Law: (4) A personal watercraft must at all times be operated in a reasonable

Last I checked even the most land based person could usually tell the front from the back of a boat (bow and stern for you nautical types). HOW could he possibly think the ferry was "moving away" from them?

Yeah, that's what confused me, as it had home address listed twice and once was celebration, and the next said Skipton, Ukraine

After doing a little research I found out that the boat accident was only one in a series of accidents for the husband.. take this one for example:

The report on this one stated that while trying to park one evening at his own home, he assumed the house would move away for him but was caught by surprise when it didn't. He did say though that he thought he was further away from the house than he was just prior to the accident.
