The think that you have to understand is the businesses like Disney. If they dont protect their copyright even for the tiniest thing, people will think that they can get away with using anyones copyrighted material anytime they want.

I guess I noticed this when I asked for the best Time of YOur Life song, it is like Napster. So I decided not to try to get it posted in here to download.

But really, has anyone seen that ride video thread? I think just about every copywrite rule has been broken there :lol:

(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;

(2) the nature of the copyrighted work;

(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

(4) the effect of the use upon the potential market for or value of the copyrighted work.

The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.

Correct me if I am wrong, but that would mean Tramps posting of the picture, and Steve's use of a Mickey Mouse are legal, because, 1.) Tramp was not using the ToT picture to make money, 2.) Tramp's posting of the picture wouldn't make people not buy the program.

And, how much money does Disney loose from Steve's use of the Mickey Mouse...my estimate: none.

I think Steve and Tramp are both within their rights.

I may be making myself out to look like a fool, but that's how I understood the copyright laws.

The way you or I read copyright law, it does seem that those are indeed "fair uses." Unfortunately, years of case history and legaleese work the other way. I would think that, 9 times out of 10, a court would find in Disney's favor in these cases. I'm not entirely sure what their reasoning would be, but courts seem to usually be over protective of copyrights. The allowance for parody and criticism (which we can probably agree is a more essential right than using Mickey for the site) is actually new to copyright law within the last few years.

All in all, fair use laws sound great and they they really help the average Joe, but don't have much muscle behind them. Consider that record companies are arguing (and will likely succeed in this argument) that if I legally buy a MP3 from the record company, I will not have fair use rights to put that music onto a CD so I can listen to it in my car. Pretty crazh, heh?

Anyway, it's unfortunate that courts feel that way, but it does seem to be the way it is.
