Who is paying the arbitrator? Arbitrators can be less than middle of the road. Seems like just another avenue for negotiations.

That is pretty much the process described, unless they both want the same person and then that person will be the sole arbiter.Usual set up (here in Europe at least) is that there are three arbitrators. Each side gets to pick one and these two then have to agree on the third one.
I guess the agreement stipulates the process of arbitration, so @71jason most likely will be able to tell us the specifics.
You could put Thor in Fantasyland and because Bruce Banner is a scientist, you may be able to fit him in with the Tomorrowland theme. For Captain America you could put him in Hollywoodland in dca.

The OP was talking about fitting them into the Anaheim parks, where the Universal contract doesn't apply.
Magic Kingdom does have a nice sized space behind Tomorrowland for a new E Ticket. IF Gaurdians is good to go, that would be a pretty good spot imo.I think something like a Stark Expo or Guardians of the Galaxy fit far better into DL's TL than anywhere in DCA. Whether or not a person like the idea of Marvel at DLR is a different story but thematically how does any of it fit into DCA except for maybe Tony Stark's home? You'd have to use a tortured "movies are made in California" concept to get it to fit.
Now, Captain America, Thor, Hulk et al -- yeah, I don't see them fitting well in either DL or DCA.

Instead of constantly jumping on people about location difference maybe you should just read more closely. There is no Hollywood Land or DCA at Walt Disney World.Then he needs to be specific about that.
Marvel shouldn't have any presence in any of the existing American parks outside the gift shops. The only place it could logically fit is DHS and that isn't happening.

I would be more interested in what UNI could do with a new Marvel attraction anyway, but again, I don't know if that will ever happen. When it comes to seeing any mention to Marvel, attractions and contracts, it makes me want to tear my eyes out.

Nah, I 100% disagree the two resorts outside Hong Kong getting Marvel rides should be DLR and DLPR.
Guardians is actually a Sci-Fi franchise that could fit and at least be more appropriately relevant for TL, unlike half the stuff they stick in that section of the park.
Black Panther could easily fit into Adventureland.
Etc.
Potentially I would be more interested in Disney focusing on Star Wars and Marvel over any of their animated endeavors ending up in the parks.
But that is surmising that only movie led properties should be replicated in the parks and not vice versa.
