While you are correct that they have a patent, it means absolutely nothing since its not going to be used. Sony also has patents for blocking used games but it doesn't matter since they are not using it. Companies are patenting things all the time, most of them never see the light of day. If MS ever decides that they will use said software, you can be sure Sony will be first in line to use it as well since they have a larger stake in the movie industry. One of my biggest issues with this system war is how Playstation fans seem to paint Sony as some saint in the industry. Does anyone really think that if MS went with the no used games, always online.... Sony wouldn't be doing the same thing? Of course they would.
If they spun it off, I still think they would have a huge stake in it. It could work out for the better since MS could then focus on software for the box and the new company could focus on the games/hardware side. If the Xbox one is as successful as the 360 was I really don't see them spinning it off anyway. I would love to see SEGA partner with MS if they did decide to sell of the brand. That would make the classic SEGA fanboy in me go crazy.
I know both company have terrible patients I was just pointing out a patient about Microsoft due to something said against Sony. I will also state that for as many annoying Sony fanboys, you have just as many Xbox fanboys, and personally I think both parties are making each other look like crap. I work in the technology industry. I know a thing or too. Sorry I hate the constant insulting of each other, and don't get me started on the PC "Master race" debate.
As for spin off, I am not too sure. On on side of the coin I could see it benefiting Xbox similarly to how I think Dice would be an even better company if EA wasn't standing over them. But at the same time, the possible CEO is the man responsible for what many people say is the demise of Nokia, so it could end badly. Most of wall-street see's Xbox as a microsoft weakness and wishes for MS to let go of the brand (along with Bing). I think I remember last year seeing that Xbox was less then 10% of their profit.
Also isn't Sega in bed with Nintendo for the most part?!
