What the article doesn't say is what happened after the cast member took away the rat. Did they take the couple backstage and talk to them or did they just walk away. If Disney walked away then clearly it is in a way Disneys fault (unless no one mentioned the biting. If the biting was made clear, the cast member should have taken them and had the bite looked at (if they have proper staff) or paid for a drs visit with rabies shots (although they have the rat so it could have been tested). A bunch of apologies and maybe reimburse for their tickets or hotel stay.. and this probably would never have happened. Ill be honest if I told Disney I got bit and they just took the rat and walked away.. I might be peeved.
Remember rats do carry rabies so besides the bite which shouldn't need stitches or anything, the real fear is making sure you get rabbies shot.

The court case number is 2018-CA-002846-O : HALDEMAN, GALEN et al.vs.WALT DISNEY PARKS AND RESORTS US INC

The incident occurred "On or about April 4, 2014".

They are suing because (and I take this directly from the complaint): "As a result of Disney’s negligence, Galen Haldeman was bitten by this rat and has been beset with debilitating medical problems ever since. Galen Haldeman has been injured in and about his body and extremities, suffered pain therefrom, incurred medical expense in the treatment of the injuries, and suffered physical handicap and impairment, disfigurement, mental anguish, inconvenience, loss of capacity for the enjoyment of life, aggravation of a previously existing condition, and her working ability was impaired; the injuries are either permanent or continuing in nature and Plaintiff will suffer the losses and impairment in the future." and furthermore that "The conditions that gave rise to Disney’s rat problem were caused by Disney, or were known to Disney or had existed for a sufficient length of time that Disney should have known about them, or the conditions occurred with regularity and were therefore foreseeable."

Count 2 (The wife's complaint): "As a result of Galen Haldeman’s injuries, Carol Haldeman has suffered the loss of support, services, comfort, society, attentions, and consortium of Galen Haldeman, and will continue to suffer those losses in the future."

They are demanding a jury trial.

The demands of evidence from Disney are as follows:

The following questions were sent to Disney to be answered and handed back to the attorney:

The attorney for the couple is David Singer & Associates as per court records.

Disney has 20 days as of March 25th, to file a written response to the attached Complaint.
so it was 4 years ago.. so unless they have proof or even the cast members name how can you prove it even happened? Why did it take 4 years? And wasn't she already in a wheelchair when it happened?

Shouldn't these people complain at the park after it happens.. I'm sure Disney would make sure that they were taken care of. Of course you cant sue for millions but your drs bills can be covered and maybe a selfie with Donald. All joking aside I'm pretty sure Disney is very generous and feels bad if you get hurt in there park. The lawsuits are becoming ridicules.

The ECV lawsuit is ridiculous, as are many of the others.

I have no doubt that Disney sees an endless stream of this nonsense. Clearly some are honest accidents due to whatever, and Disney should be responsible. But they shouldn't be responsible for fixing stupid. What's appalling to me is that people will literally sue over anything they think will net them a free lunch. Surprising? No, sadly - not at all.

Direct from the Complaint: "On or about April 4, 2014, the Haldemans were in the park, and had just ridden the Buzz Lightyear ride. Galen’s wife, Carol Haldeman, was in a wheelchair because she sometimes uses a wheelchair when her back pain flares up. Galen was pushing Carol in the wheelchair. Suddenly, as the Haldemans neared the entryway of the Buzz Lightyear merchandise store, a large rat ran into the store. Someone yelled “Rat!” and kicked the rat. But the rat just jumped onto one of the wheels of Carol’s wheelchair and clawed its way up the wheel toward Carol. Just as the rat was about to bite into Carol’s arm, Galen grabbed the rat and yanked it off the chair. As he did so, the rat bit into one of Galen’s fingers. Galen had to twist the rat’s neck, and the rat fell to the floor where someone threw an empty plastic container over it. A Disney employee ran over and told onlookers not to photograph the rat, and he took the rat away. Disney promised the Haldemans they would have the rat tested for disease, but they never did, and now it is too late to determine the diseases the rat was carrying."

^ That says it all right there... "Premises Liability."

Is it worth going to court over 15k? I guess Disney will make that decision based on what they feel is best.
That's just it... Disney will get dinged for $15k because it would probably cost that much in time and money for their lawyers to mount a defense. Though they're probably laughing... "Only $15k? LOL - pay that fool and make this go away." Unfortunately, that would mean this idiot "won" for whining. I think Disney should fight it just enough to cost the plaintiff $15k. But that's just me. 🤣

Leave the rats alone. They are far from being little evil monsters! They are in fact very intelligent social beings who like to interact with each other and their favorite humans. They are very friendly, intelligent, playful, they like hugs and are very clean.
