The merchandise is fine, the issue is more attractions and theme park usage. The monorail is definitely skirting the issue. Universal does have the rights to Iron Man as he is a member of the Avengers family and other members are clearly being used at Islands of Adventure.

Yeah I looked further and they sell all the characters merch at MouseGears. I can't see the monorail advertisements as an issue though. If anything it is mutually beneficial to Uni and Disney. Advertise the movie, movie does well, the Marvel land in Uni is more desirable. Basic line of thought, yes but I can't see a huge issue with an ad on a monorail.

Simple, Universal has the exclusive theme park rights to these Marvel characters and needs to protect those rights.

The contract was definitely muddied by Disney's purchase. If you read it the specifically restrict advertising on Disney property but Marvel can advertise as they wish. Now that Marvel and Disney are one I am sure the options loosened a bit. They must have legally reworked or at least discussed what Disney can now do post acquisition.

Edit: not arguing your point, it would seem via the contract there is an issue like you presented. Just adding to this discussion... I find it interesting.

Yes and no. They have a licensing contract from Marvel, now owned by TWDC, to use those characters in theme parks exclusively east of the Mississippi (or thats the contract language I've been told).

Universal made the giant capital investment, hundreds of millions of dollars. TWDC has spent ZERO (beyond buying Marvel) on capital investments on these characters. Universal turns around and pays TWDC for the usage of these characters. Disney then profits. There isnt any attractions to maintain, rehab, staff, operate - they just get income without having to do any of the dirty work.

So it really is in everyones best interest right now for this relationship to continue.

The issue is the monorail going through the parks, specifically actually into Epcot.

That is a dream situation for TDO. You're correct on east of the Mississippi part. All disney parks can include marvel except for WDW. Uni also has to spend a certain amount of their marketing budget to specifically market Marvel rides and they need to maintain/upgrade the rides to at least highest industry standards. If they fail to meet those stipulations the contract can be voided.

Marvel is still the entity being paid and while The Walt Disney Company as a whole gets a bump, it doesn't help Parks and Resorts. The amount paid is likely quite small as it was all set in 1994 and only increases with inflation. The merchandise money can increase with increased sales, but that would be bad for Disney as they would probably prefer such purchases be made at their store.

And everybody needs to stop guessing on what the contract says and just read it for themselves. It's short and rather easy to read. I don't have the link handy on my phone, but its been posted enough times by myself and others.

Personally, If i were Universal I would be preparing a lawsuit against Disney for Breach of Contract.

Sigh, This is getting ridiculous. The Monorail is supposed to be a marvel of futuristic transportation not a gigantic moving billboard

Futuristic? Really? There is noting futuristic about the monorail. To quote a tv star, "It is what people in 1965 thought 1987 would look like."

I personally would love to see the entire fleet of monorails wrapped. IN MY OPINION, I think the white train with the colored stripe is quite boring compared to the trains that were previously wrapped. Disneyland's trains look much better than WDW's because of color.

I am all for bright colors and decoration. It's awesome when WDW is decorated for any of the holidays, especially Christmas obviously. We live over 900 miles away from central Florida so each trip to WDW is a mega-vacation event; the more decoration the better.

The design scheme of the monorails can be changed without resorting to advertising wraps. Part of the subdued design is the different environments the Walt Disney World Monorail was intended to pass through. An image that calls attention to itself could easily become a loud contradiction. The design needed to work with the aesthetics of not only contemporary, Persian, Asian, Venetian and Polynesian design, but also a shopping district, possibly an industrial park and a community of some sorts, and whatever else the future may hold, like seaside Victorian design.

More is not always more. It is very easy to do too much and ruin a design.

disneyland's monorails look superior for a whole number of reasons: the trains are new and state-of-the-art, the LED lighting, etc. but yeah, i agree that the occasional wrap is a nice, though i prefer it as a change of pace. it doesn't bother me for whatever reason.
