Tomorrow, after class, I'll go search through the 50 page original Marvel thread and get back to you.

Thanks. I'll help you out a bit. I never said Disney made the deal to bring Marvel to the parks. That is way down the list of priorities. What I did say is I would personally like to see them in the parks. I have no idea what the mouse intends to do with the Marvel characters within the theme parks. But if history is any indication, and judging by Iger's comments, Disney franchises will be utilized throughout all Disney platforms. That includes theme parks.

Thank ya, thank ya very much.

According to Screamscape, apparently Disney is looking into having a Marvel Weekends type event that would fit in a loophole to the Marvel deal with Universal. I would assume it would be at Hollywood Studios if it should happen. They also mentioned that the whole Marvel Comic Megastore idea for Downtown Disney also might happen because it wouldn't be inside an actual park... Interesting...

I would love to see a Marvel superstore, would they be able to sell merchandise that relates to attractions at IOA, ie like a Spiderman action figure, or do you think that is also protected legally like the attractions?

I saw Spiderman, Hulk et. al. merchandise in the DTD stores over a year ago anyway, so they DO sell them (it was right near the build your own lightsaber)

I think you have to look at the Marvel movie deals to understand the Marvel/Disney Merger.

Sony, Paramount and Fox all have multiple movie deals to distribute Marvel movies. It will be 10 years before a Marvel movie has the Disney logo in front of it. And the same is probably true for the theme parks.

Yes we will see Marvel in the parks in dribs and drabs.

The ultimate thing is that now Disney gets paid everytime someone goes to Islands of Adventure. Think about it, Marvel probably got a decent percentage of the door for allowing their characters to be used by Universal. Now that money goes to Disney. And Universal has to be real mad about this merger. There is no way Universal will want to help Disney in any way. So I think we will see an end to Marvel Superhero Island sooner rather than later.

Plus Disney has a huge team of lawyers. If anyone can find loopholes to these contracts Disney can.

Look what happened to Kubtoa Robotic Arms. Universal won the exclusive rights to use them in their parks and a few months later Disney gets use of them in an Innoventions exhibit.

Disney will find a way to bring Marvel to the parks. And we will all love it.

I really hope that Marvel does not make its way into the 4 existing parks. Disney is Magic that is different than Uni and I would like it to stay that way. Maybe they will make a separate marvel superheros park but please don't include them in the current parks.

It is entirely false to say Disney will not be releasing Marvel movies soon. Some concepts are already beling worked on. So it may not be those already under contract to other studios, but there are tons of characters to draw from and new ones to create! :sohappy:

Soon!

Hopefully both of these are ways they can get around the IOA license.

Hopefully both of these are ways they can get around the IOA license.

The problem is, if I read it correctly, Disney can't use characters that are tied to an attraction, such as Spiderman and the Hulk. It really all depends on the language used between Universal and Marvel.

And as for the "Universal won't want to give part of its gate to Disney so they will phase out Marvel" nonsense, don't expect it anytime soon. The license agreement is most likely a FLAT FEE, which probably adds up to one day of ticket receipts. To act like Universal is paying a percentage of their gate for the license is unrealistic. If I recall correctly, Six Flags pays Warner Bros. about $3 million a year to license its properties...so in that vein I wouldn't expect Universal to be paying more than $5 million (if that). No matter who owned Marvel, Universal had to pay that money.

But Disney should be very careful here as well. As I said, they only receive a small, inconsequential fee from Universal. But as they attempt to find loopholes to present the characters in their parks, they may inadvertently find themselves creating demand for Universal's attractions, driving guests away for a day or two. What happens when little Ricky sees Spiderman running around DHS and oon the way back to their hotel he discovers there's a ride at Universal? As we know, many guests, while KNOWING the difference between Disney and Universal, don't really differentiate the two, and might not have a problem taking an excursion off-property.

Some key points:

"The contract allows Universal to continue using the Marvel trademarks for as long as the attractions are in operation. It also ensures that no other theme park east of the Mississippi River — including Walt Disney World — can develop attractions based on the same characters."

"......under the contract, Marvel (now Disney) has the right to approve marketing materials featuring any of its trademarks. Marvel can also approve or reject the use of any non-Marvel characters within Marvel Super Hero Island."

"The terms also prevent Universal from scaling back promotion of Marvel characters, even after they become part of the Disney empire. One provision requires Universal to devote a certain percentage of its annual advertising spending to promoting Marvel characters; another states that Universal must maintain at least 10,000 square feet of retail space for selling Marvel merchandise."

"Disney, meanwhile, could face some tricky issues of its own. For instance, while Disney could opt to incorporate Marvel characters used at Universal Orlando into attractions at Disneyland in Anaheim, Calif., it would have to ensure that any national advertising did not imply that those characters existed at all Disney parks.

That's because Universal's licensing pact requires any theme-park company that uses similar Marvel characters beyond the East Coast but has parks on both coasts — such as Disney — to "make abundantly clear that the character only appears in the parks west of the Mississippi.""

I could see there being so much friction between Disney and Universal that either Universal decides not to renew the license or Disney pays Universal a sum to surrender it. Marvel is too valuable a franchise to allow a major competitor to have a license for it.
