Boy, this pi$$e$ me off! I hate people like this who take no responsibility for themselves or their actions. If it were up to the lawyers and people like this, the only rides we'd be able to enjoy would be sitting in a non reclinable easy chair in a dark room with no noise. I wonder how much of this lawsuit is coming from the patient himself and how much from his "concerned" family members (salivating at the thought of a big fat settlement or decision in their favor). I hope Disney's lawyers drag this out for years and bankrupt the plaintiff in legal fees. A-holes.:mad:

I still think this is a total crock of crap. The guy had a stroke 3 weeks later, unless he was sitting on his bum the entire 3 weeks, then there could have been hundreds of other situations that could have lead to the injury and the subsequent stroke. I could see if he had a stroke while on the ride itself, that is a little more of a realistic correlation. But come on....3 weeks?:brick:


My only argument to that is that it could have been a pre-existing condition that was exaserbated by ToT.

Not saying it's likely, but it could be. Then of course, you still have the "pre-existing" condition argument. Which might be why Disney is fighting this, since that seems to be the new plaintiff mantra lately.

I'm not saying this isn't a load of garbage, but I just want everyone to think. This article is a brief snipit of the whole case, we don't know all the facts. Arguing for or against Disney or the plaintiff off of one article is not wise.

If I had an upset stomach and sued KFC for eating there 23 DAYS earlier, they'd throw me in the loony bin.

The room would have to be lit. And well lit. A dark room is a tripping hazard.

Sorry but when you do trill rides at 68 years old you have more chance to have a heart attack or stroke so he should knew about risk. There is always a risk even for children or even adult so it should be your own responsibility if you decide to go or not. It's not the only place that have that kind of ride and it would be stupid if he win's it because LOTS of people are going to put lawsuit to every theme park.

I believe that they are alledging that the forces of the ride tore an artery that led to the stroke which is in the realm of possibility.

How you would identify exactly when and how an artery tore is out of my range of medical knowledge.

I'm guessing it would be tricky, although like you I have no specialized knowledge. But the fact that we're even talking about this makes me think Disney isn't convinced they'll be able to demonstrate a connection.

Exactly which is what I'm saying, there is no possible way to prove that this is the case unless he visited the doctor prior to getting on ToT and got an MRI, CT scan, etc...then did the same thing directly after getting off the ride. Since this is highly unlikely and virtually impossible without introducing other variables into the equation, I don't see how they can prove without a shadow of a doubt that it was ToT that caused the tear.

That's a pretty ballsy accusation, if that's what they're going for. If they think the forces are that intense, you'd figure this would happen all the time, which it doesn't.

I really don't see them having much of a case here, but we shall see.

Could it have been the 67 years of eating food fried in lard that caused his artery to weaken? Maybe he was a smoker and/or diabetic too? ToT may have HELPED him have a stroke, but the stroke was inevitable.

Just like the boy (or girl, I forget) who died on M:S - the ride didn't kill him, his bad heart did. It just took a ride to bring light to the defect.

Im not sure you could. Although, Im sure you could find plenty of sleazy doctors that would like the ones seen on those commercials speaking on behalf of some weight loss drug.

so is this the end of thrill rides at disney? :cry: sad cause i thought they did them very well! and i was looking forward to more! but i guess after this they will ton down all the ones they have left and never build anymore again! :cry:

Yup. They will be bulldozing every ride or attraction that moves, is in the dark, has any noise, or doesn't have enough warning signs.

They're also closing down any food service location that serves fried food.

The remainder of the buildings, planters, light posts, trees and free-roaming animals will be covered in bubble-wrap for your safety.

Instead of putting the blame on Disney or the Tower or Terror ride how about he blame himself for being so stupid to go on the ride in the first place. This type of stuff really annoys me. There are warnings on some of the more crazy rides at Disney and if you don't want to read the signs then it's too bad if something happens. Disney can not be responsible for decisions people make on their own well being. That is like a person deciding to jump in a lake where it says Alligators are, well if you jump it's on you....jeeeeeeezzzz :hammer:wake up.... Sorry for going on and on, I just hate this type of stuff.....

Oh good now everything is nice and controlled! But someone wold still try and sue even if you put all guests in bubble wrap! if it popped they would sue cause they could have gotten hurt! Oh america the sue happy country, so sad.
