Disney wins Tower of Terror lawsuit

Jurors have ruled that the
Tower of Terror attraction did not cause a man's stroke 12 years ago. Marvin Cohen, 80, sued Disney in 2002, saying that he wasn't aware that the Tower of Terror was a thrill ride and that the movement of his head and neck on the ride led to a stroke several weeks later. After a three week trial and a three hour deliberation, jurors sided with
Walt Disney World, saying that the ride is not dangerous and that Disney had done nothing wrong with offering the attraction.
It's interesting to note that out of all the ride-related suits in the past several years, this is the only one to be heard by a jury. The Orlando Sentinel reviewed hundreds of lawsuits against theme parks in the last year and found this to be the only case that did not argue equipment failure or operational malfunction - it challenged the ride itself. The jurors addressed that issue with their verdict statement: "Was there a dangerous condition on the tower ride called Tower of Terror on March 28, 1998, about which the Walt Disney World Co. either knew or should have known, by the use of reasonable care? No."
Cohen still has an option to appeal.
