I was just asking a question about the example you used. And I'm not sure Disney would have a problem with WDWporn.com because they allow all that Disney princess on the web, I'm sure there's some legal loophole but I can't believe Disney allows that?
Disney of course would rein all that in if it was feasible, but that is out of scope of this issue. You are talking about two large companies going after each other over website names, not thousands (I would assume) of privately composed graphic images distributed across thousands of websites.

If your Disney you probably don't want to even acknowledge those images are out there lest you be linked to them in any way. It only takes one rogue source to claim that a Disney animator produced them to make that the assumption of the general public.

I have never heard of the princess (and I'm not going to do any research regarding it...) but that is interesting. Are they clearly identifiable Disney trademarks, or just similar-looking princesses?

In any case, Disney would sue if the company had a problem with it, regardless of whether Disney was in the right, legally. Disney often uses the law to strongarm. I am surprised to hear about the princess thing if there is a clear association with Disney.

That makes sense. I was unaware that this was 'widespread.' I imagine there is at least one organization that is fairly large and producing this type of content, it seems Disney would consider going after them to set an example and scare others. Although then they run the risk of media publicity, and people like me learning about something of which they had never heard, and perhaps erroneously associating it with Disney.

Yea I wrote a paper on it a couple of years ago and they look exactly like the Disney Princess's.
 
Not that I condone copyright infringement at all, but does anyone suspect that Disney would have foreseen this with so many lawyers? This leads me to believe that they're testing the waters to see if Luxo would get involved over a toy baring likeness to the lamps. Maybe disney's new approach is to wait and see with legal matters which they feel either can be circumvented around copyrights and things, or smaller things they feel may fly under the radar. Irresponsible? Yes. Yet I really don't see a problem with marketing toys that look like Luxo lamps when no one would confuse the craftsmanship between plastic and the nice, shiny metal (and other goodies) Luxo would use. Heck, I'm sure there are many people who have no idea Luxo Jr. is based on anything real, retail lamp.

Widespread might be a poor choice of words since I haven't researched exactly how many websites contain these images. My exposure comes from simply misspelling Disney in search engines. If the number of websites that popped up are any indication there are quite a few, but it didn't appear to be one central location, just your usually adult content mish mash.

The Luxo Jr. lamp replica in the link above does look like a piece of cheap garbage. Even in a small internet picture, it's obvious.

It's like the new reproduction retro lunchboxes. Garbage.

You would think for the $200 price tag they could put in an actual quality working Luxo lamp. Maybe they can work out a deal with Luxo and have them make the lamps being sold and let them share the profits, a partnership on limited merchandise would be a much better solution than to settle out of court and sweep the remnants under the rug.

Maybe they are pushing a bit to see what they can get away with. The problem is they certainly don't extend that view to anyone they see as infringing on THEIR intellectual property. If what you suggest is true, I'm afraid Disney is being very hypocritical.

"Luxo Jr." is the hopping desk lamp that has been the mascot for Pixar since 1986. John Lasseter used his own Luxo desk lamp as a model for a short computer-animated movie, which was later nominated for an Academy Award.

Luxo, a Norwegian lamp maker, filed a federal lawsuit against Pixar and Disney saying their use of the name Luxo is infringing on the company's copyright. Disney-Pixar is including a limited edition "Luxo Jr." lamp along with Blue-ray discs of "Up." Luxo is also upset about the six-foot animatronic Luxo Jr. attraction at Disney's Hollywood Studios.

According to an article in the Los Angeles Times, "Oslo-based Luxo said in the complaint that the Luxo name hadn't been used on Pixar and Disney products until now and that sale of the Pixar lamps would cause devastating damage to Luxo and dilute the goodwill which Luxo has built up."

So wait, this isn't about Pixar's use of the Luxo name in their cartoon, this is purely about creating actual Luxo merchandise and animatronic figures, right?

Luxo Jr. was created when Pixar was a much, much, much smaller company than it is today, years before any relationship with Disney. The character was created by John Lasseter when he was learning how to model in 3D, and he pretty much animated the entire short himself. Luxo has been a recognizable mascot for Pixar for years now, but only recently has the character really been pushed to a new level in its use in merchandise and Theme Park imagery.

According to the article, this is a federal suit against Disney for use of the Luxo name as an infringement of copyright.

IF the reporter reported this correctly, then Luxo has absolutely no case whatsoever, because names are not copyrightable under U.S. law.

If it was misreported and they are suing over trademark infringement, then it's a different story.

Likewise, the whole distribution of copies issue would as well have to be based on either a) infringement of artwork (copyright) or b) patent or trademark law, for them to have any case.

So long story short, if LUXO wants to get a dime out of Disney, they better hire some lawyers who are not of the Cracker Jack box variety.

I have received word that Luxo Jr. is experiencing technical problems and his performances have been halted for the time being. Imagineers are working on the problem, but no date for his return has been announced

I know this is off topic, but I figured you'd be the best person to ask.

I'm headed to the world with the family during Christmas time, and I was wondering if Luxo was going to have any special holiday shows?

I know it was directed toward Servo...but I'll answer.

I think there was talk of a holiday show,but I do not think it will happen this year as they are still programming the regular show.:)

There should be. I recall a short stint in which Luxo Jr. conducted a light show from nearby trees.

Now add Christmas music & a Santa hat for Luxo, well... :D
