I was wondering if DeSantis would just let this die, having made his symbolic point, but it looks like he's appealing the ruling.

Like I said I think this might make it all the way up to the Supreme Court.

It will now go to the 11th Circuit of appeals. If you google their record you will see this has a good chance it will go higher to the Supreme. (if the Supreme takes the case that is)

An interesting question I heard (and don't know the answer to) about employer mandated vaccination. If an employer (like Disney) mandates vaccination and then an employee has an extremely rare serious side effect, is the employer liable for damages?

Even if they were…that would he in the “actuarial margins” for an insurance company.
I'm still curious if they'd be liable. For Disney, when their liability insurance is spread over such a large pool of people it's a negligible risk but what about for somebody who has 10 employees? Will their liability insurance premium increase due to a mandate on their employees?

That is a fair question. Then I suppose lets put it a different way. Since it reopened how many people have been infected there compared with the number of visitors? Is the ratio extremely low? A handful? Any? Actually I would like to see real verifiable information on that (both infected and the number of visitors) not conjecture.

Nobody has really looked. Despite Orange County claiming to have looked at the parks those claims also occurred when cases far exceeded their admitted capacity to contact trace.

Unfortunately, I don't think there's any mechanism in place by which to determine this information.

Impossible question to answer. No one gives out that information. There have been documented cases of CM’s getting it but who knows from where. I’ve seen articles on people saying they were tested when they got home because they didn’t “feel right”. Again, no idea if they got it at the airport.. a Uber ride.. in the parks.. etc. That’s the big question and it can never be answered.

From a hospital perspective…since most healthcare facilities require all staff, except those that meet certain requirements, to receive an influenza vaccination annually…there aren’t any I’ve seen that absolve themselves of liability. There is however a rather lengthy form to be filled out, indicating current and past medical history for those who should not receive the vaccination. The form must be acknowledged with your signature. But again, no release of liability form that I have ever seen.

In order to work at wdw a cm has to ride transportation (personal vehicle or bus) - is Disney liable if they get into an accident while traveling to work? It’s required they travel to work in order to be employed by Disney.

I wish we had done more contact tracing so we knew.

I wonder how closely Disney watches these developments?
i doubt disney would require guests to be vaccinated before entering parks, etc. that’ll mean turning money away. no way that’s happening.
plus u have guests coming soon for the boo bash after hours. i guarantee not everyone attending is vaccinated.

I don't think that's the same thing legally. Transportation to a job is different than something that happens on the job. Being required to be vaccinated is closer to "on the job."

The CM doesn't HAVE to ride transportation. They could live right outside the main gate and take a long walk. Obviously, nobody does that but I don't think transportation to work and required vaccination to be employed are the same thing legally.
