I should add by way of context that my father is currently on a ventilator fighting for his life. I already took the virus very seriously before he was hospitalised, but I’m even more careful now.

I would never comment on how many masks someone wants to wear, it's their choice. :) I'm sorry to hear about your dad, my dad is sick too. (not covid though)

Reports suggest that the White House is considering domestic travel bans to Florida amid steeply rising U.K. variant COVID-19 cases in the state​

Probably should have pulled the trigger on that before this past weekend.

But I LOVE it when people preach the Constitution.

There’s hardly anything in it. 99.9999999% of our laws come from Acts passed on the federal/local levels and by case law determined in the courts.
Don‘t forget your buddy Ron was setting up roadblocks on I95 heading into FL last Spring. Somehow it was constitutional back then.

The US supreme court in 1941 established a constitutional right to interstate travel, which if litigated would supersede this. More likely if implemented there would need to be a way to restrict to a specific grouping of people. Issuing a blanket across the board restriction would likely be shutdown quickly by the courts.

There are interstate commerce laws that this would break, so it is certainly unconstitutional and, I agree, an effort to push certain individuals to knock it off with dangerous behavior (including folks dreaming of Spring Break trips who may hold off with this announcement). Even mandatory quarantine rules have had more holes in them than Swiss cheese.

Speaking to 2 lawyers I know just now they said this would get extremely messy

In the court system for a while maybe even going to SCOTUS

I am in the boat this is NOT going to happen

This is to put pressure on Florida

Perhaps you misread what I said? I said the Constitutional or legal authority. I wasn't saying that the answer had to be found in the Constitution.

However, I do think that about 95% of our laws and court decisions go against the plain text of the Constitution, FWIW.

It very likely is unconstitutional and would be struck down very quickly since there is existing precedence which ensure that Americans have the constitutional right to unabridged interstate travel.

So they want to target the Florida Governor, well what happens when California mutant variant numbers kick up? or NY? or Texas? It's an especially foolish strategy given what appears to be declining cases overall and increased numbers of vaccinations been administered.

What there're really are, are trial balloons being leaked to the press. It happens all the time when leaders can't make decisions. Last week was the domestic CV-19 testing requirement for all airline travel. It was met with swift resistance from virtually everyone impacted. This is more of the same, to gauge reaction. Remember these people don't care about the practical result of restrictions or the science, they care about the politics. And if they say that they will follow the "science" then you absolutely know that it is political.

Yeah:..pretty slam dunk on the Interstate Commerce Act here

Which is very difficult to do if the cases and positivity continue to go down, despite the "exploding" nature of this new variant. Follow the science and all the rest, etc, etc.

The rules we live by are in many cases much more “modern”

Translation:
Florida won't listen to the federal government telling them what to do because they feel all jobs are essential and Biden is ticked because he and the Democrats feel only some jobs are essential and want to destroy a lot of small businesses. Biden is also ticked because DeSantis told him where he could shove it.

We are scheduled to leave next Friday, really hoping that if they do try to do a travel ban it doesn't happen or take effect before then, this is getting pathetic, we have a vaccine, Florida is on top of getting its population vaccinated more than most states and yet we have this kind of craziness happening and no, I don't think there is a great danger in Florida any more than anywhere else, you just need to take common sense approaches to things, life has risks, it is time we accept that.

Which is not always a good thing.

Regardless, whether you're talking about the law or about the Constitution, my considered opinion -- admittedly, as an IT person, not a lawyer -- is that any attempt by the federal government to restrict the mobility of American citizens from one state to another would likely be quickly struck down by the courts. And I agree with you that Biden is not going to do it anyway.

Also, that is a TNG-era red alert sound (you can hear the Enterprise-D background noises) with a TOS movie-era red alert graphic. For shame. :)
