Yeah there's no way. Worst case scenario is that Disney has to modify their internal reporting a bit. Many of the points talk about comparing expected attendance with actual attendance but it's phrased in such a way that they seem to be talking about individuals. It says "who [emphasis mine] is expected to be in attendance," not just what the attendance total was projected to be.You're absolutely right. None of the claims mention RFID. Only in the description does it say "In one embodiment, the tags are Radio Frequency Identification (RFID) tags". But the claims are all important when prosecuting IP infringement.
Looking at the claims, claim 1 holds priority (all other methods are dependent upon claim 1). I'm not sure Disney will have a hard time defending against this. Remember - you have to do all of the steps in claim 1, or else you don't infringe. Some people who are more familiar with the operational aspects of MyMagic+ may know more, but -

The attendance report has to be sent to a person in the area. This could be broadly defined as to what constitutes the "attendance area".

Sounds like the person who is getting the report needs to be able to physically observe the guests. This could be an easy way to get around the Incom patent.

modifying the provisional attendance report to correct the differences of said identifying step to establish a second attendance report, the second attendance report being more accurate than the provisional attendance report.
So, the physical inspector is helping to look for discrepancies in the attendance report (maybe looking for "gate jumpers") and correcting the report. These are pretty specific operational aspects of the way the attendance report is treated. Again a fairly easy way to get around the patent.
I'm not sure Disney has much to worry about. This patent is fairly restrictive in it's claims.

I had a bit of a non-MAGICal experience at said location on Sunday night. Oops, not there, but the bar next door. We were seated enjoying a beverage and then talking and a CM came over and basically said to 'move your @rses away, we have a private group that have rented this area moving in, even though we're open for another 3.5 hours'. I think we should have complained at Guest Relations and demanded a free dinner with drinks at the Brown Derby for being treated like we didn't matter (PML fodder or not?)
Most depressing FP+ lineup ever? Dumbo, Pooh, and Mermaid. And that's how I spent my day last Tuesday. WDW with an infant is a joy and a pleasure.Again, it's the people who don't know better who book a FP to meet Cindy, a FP to ride the Mad Tea Party and a FP to view the MSEP who are getting screwed by this. And many are first-timers who won't return.
