Viewer Sues Over 'Fear Factor' Rat Episode

Apparently nausea was a factor for a "Fear Factor" viewer who is suing NBC for $2.5 million, contending an episode in which contestants eat rats made him vomit.

Austin Aitken said he watches "Fear Factor" often and had no problem with past episodes in which the reality show's contestants ate things like worms and insects in pursuit of a $50,000 prize.

But the Cleveland man said showing people eating rats mixed in a blender was degrading to the contestants and the viewers.


"These networks are going too far. Period," Aitken said Thursday. "They need to check themselves, clean up their own acts. It's barbaric, some of the things they ask these individuals to do."

Aitken's handwritten lawsuit contends the rat-eating made his blood pressure rise, making him dizzy and lightheaded.

"I didn't see the doorway on route to my room," his lawsuit reads. "I ran into it causing suffering, injury and great pain."

Asked why he didn't shut off his television before the rat-eating segment, Aitken said he couldn't do it quick enough.

NBC responded with a brief statement: "We believe that the claim is completely without merit."

Aitken, 49, said he wants to send a message to NBC and other networks with the lawsuit. He said he isn't concerned with winning a cash judgment in court.

"I just put any figure. You really think I expect to get 2.5 million?" he said.

Court records show Aitken, who works as a paralegal, filed two lawsuits against tobacco companies in the late 1990s. Both were dismissed.

$2.5 Million???? What is this idiot thinking? "Gee. Worm filled sausages and cow testicles are ok. But blended rat... :hurl: " It's right up there with the McDonalds made me fat lawsuit.

That's like saying your gonna sue NBC for that SNL lip singing episode, because it showed that pop singers can't really sing.

And if you put $2.5 Million, then yes, that is what you expect to get!!!!!!!!!!!!

I really wish there were a "loser" pays all costs law. Right now, it's cheaper for the defendant to settle than to litigate. If the loser had to pay all court and lawyer costs, it might make people (read, lawyers) think twice about suing someone.

LOL:lol: This lawsuit is complete bs and a waste of the court's time. I can't belive people continue to stoop to ever lower levels of decency.

Yeah I saw some dude vomiting after riding Mission Space, it made me severly nausues and ruined the rest of my time at Epcot. I am going to sue Disney for having a ride that may make someone nauseus.:rolleyes:

This thread made me laugh! :lol: I always wonder, though, how PETA isn't coming after these reality shows with a vengence. Or perhaps they are, and we just don't hear about it.

Thanks for a great laugh. I read the article to my family and we had a lot of fun coming up with people to sue.

That guy will never win.

Microsoft for making the program used in displaying it.
Comcast for allowing me access to it.
Dell for allowing me to have the programs in order to view this page.
My electric company for allowing me to turn my computer on.
