Disney Lawyers are TOO POWERFUL. Disney will win.

And I am sure they have been involved all along and prepared for things like this

I would be shocked if this goes to court and the lose

Now, could there be some sort of out of court settlement just to keep everyone quiet/make this go away? Could see something like that happen

Although the original intent of this to force Disney to make meaningful changes to the failed DAS system, I agree with you some settlement will happen and the DAS system will remain the same.

Could also see some small changes happen along with the settlement (more training for the CMs involved, etc) maybe some expanding of alternating accomodations.

But no way they are going to go back to how things were before when everyone and their brother was seemingly able to get DAS

I hope this forces some changes to DAS. Lets see what happens.

Personally I don't think anything is going to come out of this. While these people no longer qualify for DAS, Disney has made many alternatives to help those guests.

Neither do I. I would be very surprised if Disney didn’t make triple sure they were covered legally before making the change. A lawsuit attempt seemed inevitable, just like when they switched from GAC to DAS in the first place.

I wonder if this explains the small wording change we saw recently though.

As someone who used to be able to get DAS and while I haven't gone since the new changes went into play, doubt they'd approve me now (and I didn't go to a Disney Doctor and get paperwork just for parks, I've had this condition my whole life), I agree with the statement that Disney is 10x more likely to gut the system completely and offer discounted lightning lanes for those apart of DAS than ever bring the system even half way to what it was before.

Disney has punished people who had the issues covered by DAS that had their stays improved by the system because they were overrun by influencers selling it as 'free fastpass' and Disney saw the word 'free' and went to work burning it all down and salting the Earth.

Is Disney required to offer DAS?

What I'm reading elsewhere is they have to be ADA compliant but any offering like DAS is strictly optional.
There is no requirement to offer "DAS" -- the program as it stands today or as it was in the past.
However, as PP mentioned, they do have to offer reason "reasonable accommodations" for disabilities. What that involves and how it looks or works can vary.
