And to lock things up even further the contract says that if they are using one member of a "family" of characters then they have exclusive rights to the entire family. The contract specifically mentions The Avengers as an example, so since they have the Captain America Diner that gets them all the Avengers, Storm Force Accelatron gets them all the X-Men, and Doctor Doom's Fearfall gets them all the Fantastic Four related characters.

So wouldn't the movies "captain america" differ from the comic book version.... I heard from somewhere...because Disney and marvel were together when Capt America and Thor were released that content and Characters are owned by Disney... and the movie characters are considered separate...so in terms of a ride .... A Captain America: The first avenger ride can be made...because it isnt based on the comic book but rather based on the movie... this is what Ive heard from my law professors

I get the feeling as soon as the movies for Guardians of the Galaxy or Inhumans get off the ground, we'll be seeing Rocket Raccoon, Groot, Star Lord, Gamora, Nova, Black Bolt, Medusa and the others hanging out in Tomorrowland or something

True, Disney does not own the rights to the movies, but the contract with Universal only refers to the use of characters so just because someone else has the movies rights it doesn't allow them to get around the contract.

The movie characters are still based on the comic book characters. They are still Universal's in theme parks east of the Mississippi River.

The source of the character doesn't matter. If Universal is using any character in a contractually significant way, that character's entire "family" is off limits, no matter the intended use or movie/comic source. They are not new characters, they're just being used in new ways and mediums.

O ok.... well when does this particular contract end... and can Disney possibly restructure the contract.. I mean im sure Universal has to pay loyalties no? ... The content is still Disney's no?

i just read the contract... Disney has no rights to make any movies with pretty much any marvel characters for a very long time.... they cant use anyone in theme parks... I dont get it what was Disney thinking???? this was a mistake i THink... 4 billion and you cant even use the content you have purchased

The contract only applies to theme park use. Disney plans on distributing several Marvel films starting with The Avengers. Disney is looking at the long-term value of Marvel, not just at current contracts.:)

the contract i read said that the avengers was being distributed by paramount ... along with IM3 and THOR 2

Universal's contract only applies to theme park rights, especially regarding UO. Disney bought Marvel for the movie and merchandise side of things, the theme parks were definitely a bit of an after-thought. Disney is in the progress of negotiating/buying out the production and distro rights for any Marvel movies that had already been contracted for the future (see the Avengers and Iron Man 3). Paying $4 billion for a franchise just to use in their parks would be a stupid move. It was done almost entirely for the movie and merch business.

Disney has bought the distribution rights to The Avengers, Iron Man 3, and the Thor sequels. They own them. However, since The Avengers and Iron Man 3 were developed at Paramount, that studio will receive maybe 8% of the profits, as well as their logo featured along with those two films.:)

It's under the Marvel banner. Universal has the rights to it in parks east of the Mississippi.

Disney bought out Paramount's contract. Just do a search for "Disney buys out Paramount" and you will get lots of stories. That said, the current poster and trailer for The Avengers both say Paramount with Marvel Studios being the only part of The Walt Disney Company mentioned.

I've often thought that Disney would have tapped some of the Marvel creativity to develop some new Marvel characters that they could incorporate until the Uni contract ran out and they could open that Marvel 5th gate thingy.....

Thats good news!! But DIsney can not incorporate the avengers into their theme parks..thats bad news..... how long until the contract is up?

The contract has no specified end date; Essentially Universal retains the rights to the Marvel characters so long as the attractions/theming remain (again, the details are all in the agreement which is freely accessible online).

Until Universal decides they don't want the Marvel characters, basically. The specific terms are in the contract to read, but the short of it is that as long as the land and attractions remain in good repair, they have the rights. For Universal's sake, I hope TDO is the one doing the evaluation with their opinion of "good repair." :lookaroun

well they are refurbing Spiderman as we speak ... I just think Disney would do a better job with a Marvel Studios in DHS than Universal is currently doing at IoA ... the marvel section just feels to small ... but thats just me i guess

Honestly, I don't see this. If Disney had the rights to Marvel I expect they would build a single attraction, gift shop and have meet and greets. Maybe add them to a parade. That's about it.

I seriously doubt they would develop a whole land around them like Uni did.

3 years ago I would've agreed with you. Now, I think the opposite.

Marvel is Igers big play, he wants to squeeze as much $$$$ out of it as possible. If they had the full theme park rights to Marvel in Orlando I'm sure we would be seeing a Marvel Universe land at DHS rather then Avatar at AK.
