Police do not need to assume everyone is licensed. You may be challeneged... Especially if there are other factors involved. Federal courts have ruled even in an open carry state, the police were not in the wrong in detaining someone while issues were clarified

The issue in the case you cited was that the anonymous tip without any other observation, behavior, or evidence was not enough to justify a terry stop.



Basically - an unverifiable tip along with no indication of illegal behavior is not enough to justify a search. That's not same situation here, nor the same as if officer saw your concealed weapon.
From what I gathered from what I read it sounded like the security officer told the deputy he saw a bulge that he thought was a weapon but didn't even have direct knowledge of a weapon, so this was not only second hand information but an assumption. The deputy from what I gathered was working on that information and apparently was following him, this to me would suggest he couldn't see this himself. As I said before I don't think this is necessarily a good defense but merely that it might be something that could work if the situation justifies. Without knowing all the finite details it's hard to know exactly how this will go. Like I said though I would be interested in hearing a follow up.

Open carry has it's own completely separate issues and is a balance on the edge of a knife. You either are a show of force making someone think twice, or you paint a target on your back for someone who is intent on causing harm. The only time Open carry works is if a collective group partakes in it. At the same time the "Open Carry" groups show us just how well a response that has received.

A man was arrested earlier today attempting to bring a gun into Disneyland Paris:

A man with two handguns was detained Thursday along with his female partner at Disneyland Paris, Europe’s most-visited tourist attraction, police said.

No one was hurt in the incident and the park remained open after the arrests. They come as France remains on edge and under a state of emergency after Islamic extremist attacks around Paris in November that killed 130 people.

The man, 28, was detained at the New York Hotel, part of the Disneyland complex, according to a police official who wasn’t authorized to be publicly named. He was also found to have a Quran. The man’s motives for trying to enter the hotel with weapons were unclear.

Employees at the New York Hotel and several others around Disneyland Paris said they continued functioning as usual after the arrest.

There is 'Open Carry' and there are open carry nuts who take it too far, I live in a open carry state, It's useful at the range and other shooting events because other than basic firearm safety there are no laws to break when carrying. I also have CCP but that's because our state has a loose definition of 'concealed' if I'm wearing a vest and it covers any part of the weapon it's now in the law's eyes 'concealed' even though i'm not hiding it.
