Disney will be bringing a preview of the new Marvel film, Guardians of the Galaxy, to Disneyland and Disney's Hollywood Studios. At DHS, the 3D clip will begin playing July 4th at the ABC Sound Studio. I wonder how this fits into the Marvel contract with Universal. So, they couldn't drive a Marvel wrapped monorail through Epcot, but they could have a "show" based on Marvel? Something doesn't seem to add up. Or weren't these characters part of the designated group for rights in the contract?
EDIT: Also, it's interesting they're doing almost continuous movie previews. Will this keep going on and on instead of a new attraction at the ABC Sound Studio?

Guardians are honorary Avengers based on a 1970s story. I don't know that connection has been exploited since so it would be up to an arbitrator whether that is a violation

I don't know the specific details of the comic storyline you are talking about, but the team upon which the movie is based was created in the 2000's. The earlier Guardians of the Galaxy team was created in the late 1960's and is basically unrelated to this new team except the second team copied the name. I believe it would be the earlier team that was "honorary Avengers".

That's not to say that the movie and use in the Marvel Cinematic Universe won't connect them to The Avengers and thus be part of the Uni contract issue. So, I dunno, it's murky.

It does seem like the presentation of Big Hero Six is going to avoid this altogether and should be free reign for use at WDW if Disney desires.

I hate to be negative but this film looks like a turkey so I doubt Comcast cares. But it brings up good questions about future Marvel characters at WDW. Gotg have been in the Avengers comic book so it throws out a lot of the "backseat lawyers" explanation of the infamous contract.

I don't see how showing a preview of a movie, which is all this is, is any sort of violation. It's not like they're creating a stage show, or having walk around characters.

If this works what stops them from an Avengers preview? Disney might be starting to flex their muscles here, now I don't see Marvel at WDW as being impossible.

It's like saying they can't show the movie at AMC in Downtown Disney, IMO. I don't think they'd announce basically showing an extended trailer if there were an issue. And why would Universal even care about a movie trailer being shown? I'd imagine they have other things to worry about.

Uni wasn't using anyone in this version of the Guardians family at IOA, so their claim to them doesn't reach NEARLY as far as Avengers.

The TL;DR? As long as "Guardians of the Galaxy" and all of its characters do not include any character used at Universal Orlando, or any character in the same Marvel character family as any character used at Universal Orlando, Disney's okay to use them at Walt Disney World. But that doesn't mean Disney's completely clear. Skip to (iii), a few lines down:

permitted uses shall be limited to the use of specific Marvel characters and Marvel may not permit a licensee to use the name “Marvel” as part of the attraction name or marketing.
You'll notice that Disney's blog post announcing the preview never uses the word "Marvel." (It says, "From the studio that brought you “The Avengers”...") There's why.

DD is not a park. Plus, if Disney is going to list it as an attraction on the Times Guide (which they will if Maleficent has anything to say about it), then it would be a violation. But...

And X-Men and Spidey, but those film rights don't CURRENTLY belong to Disney anyways. Really, though, I wonder if EVERY CHARACTER that IOA even has painted on that impact statue counts in their contracted use. So far, all signs point to "yes".
At the end of the day, though, I trust that Disney and Uni will keep one another legally in check, so all of our armchair analysis is truly silly.
