Is GOTG part of Avenger Family? Yes
The original team was made honorary members in one of the annual books.
The new team was join a year ago by Iron Man Tony Stark for several months while he was in outer space. He ask them to become a team of Avengers who protect earth from anything from space . New to the team in the comic is Spider-man villain / friend Flash Thompson as Vemon and former Avenger Captain Marvel.
A former GOTG member Angela is now to going to believe as Thor sister.

After watching many episodes of Matlock, LA Law, and other "laywer shows" on TV, I feel that I am very qualified to say that I have no idea whether this is legal or not.

I second this opinion fact.

I thought it was Marvel as in, all encompassing Marvel not just Avengers, but what do I know, I'm just a tourist.

Well, whatever it is, I'm sure Disney researched this thoroughly, knowing full well any possible repercussions, if any. I highly doubt that last week they decided to throw a preview together and put it in the parks.

Or they are just going to do it and hope Uni doesn't call them out on it.

Looking at the contract it makes no mention of the timelines involved of just exactly where and when "families" originate. Are the certain exclusive families based upon what was then known when the contract was signed? If that is the case, Disney would have a lot of leeway in terms of dictating just who they can and can't use.

Speaking of which, I would also put Daredevil as a character without an exclusive family.

A billion dollar corporation hoping they don't get called out? That's a completely ridiculous scenario.

That is allegedly what happened with the Avengers monorail wrap.

[Edit] Here is the source for this:

Just a quick post before I head out for the day (you awake yet, Lee?) ... but there are already legal issues with Disney's wrapping of the monorail because again as we all -- even JT -- understand, Disney has no rights to use UNI's Marvel characters in any/all parks east of the Mississippi in perpetuity.
Well, UNI Legal contacted Disney and threatened a major legal action and informed them that this was a breach of contract and that the monorail couldn't run. Disney Legal responded that the contract only covered use in theme parks and the 'rails are transportation.
They are still going back and forth, but it was made very clear to Disney that they could not, would not be allowed to run the wrapped train in EPCOT because that IS a theme park ... and UNI is still not happy with it running at all with images of the Hulk on the side. So, it will be interesting to see just what happens.

Allegedly? Rubbish. Its pretty obvious Disney has a legal team who actually know what the "contract" does and does not state. Anyone making claims otherwise is obviously lying. Just the thought of a billion dollar corporation "hoping" they don't get caught is completely laughable. I cant believe people are so gullible.

I'd catch this if I were there. For the time being, I think this is a good use of that building (extended movie previews). I don't think GOTG will need it though. Looks like a hit to me.

But if what you say is true, large corporations would never end up in contract lawsuits, which we know happens all the time.

I'm going to disagree on that. I think it looks like a dud. I hope it does well.

Oh I think it will do well. I personally love the trailer and all the Marvel movies from the past 3 years or so. Zoe Saldana, Chris Pratt, and Bradley Cooper all have their fans as well not even counting Marvel fanboys. It may suffer from coming out in August though.

It depends on your standards.. many people said The Winter Soldier look crappy.. the trailers were weak.. and it was incredible!.

GOTG isnt supposed to be as serious as AVENGERS or Iron man ..etc..

Its supposed to be more campy due of their characters.. they are so mismatched they make a weird team.
Also, the GOTG are more related to save the galaxy (cosmisc proportions) than the Avengers doing it exclusively to earth.

to me GOTG as the opportunity to be as funny and good as THE FIFTH ELEMENT.

When in The Avengers was anyone trying to be serious? To me it was one big banter-fest, they even turned The Hulk into a "comedic gorilla" where he punches Thor for no reason, beats his chest like a gorilla at one point, and even walks on all fours during some scenes.

Seems to me that GotG is just following in the same footsteps as Avengers, Iron Man 3, and Thor 2...

When was the last time Disney had a successful breach of contract lawsuit filed against them? Or are you attempting to try to lump them in with other "large corporations" as a whole because your argument is moot and its the only way you can attempt to save face?

I'm definately a Marvel fanboi but the characters are not the most compelling to be sure. I hope to be wrong and would love a huge slice of humble pie with whipped topping, but unless the film is amazing, I just don't see it doing well.

I misinterpreted your post, I thought you were saying that no billion dollar sized corporation would try something like this. I still stand by my original assertion. I would not find it surprising if Disney attempted to do things with Marvel at WDW to "test" whether Uni would push back or not. Clearly they wouldn't do this with things that are a clear violation, but with things that are in a potentially grey area they might, especially if there wasn't a lot to loose by doing so.

Here is my source on the original Monorail wrap situation:
