Herbert Hovenkamp a Wharton professor and the "dean of American antitrust law" believes the DOJ has successfully made their case against AT&T-Time Warner.

As I've said, this case is nowhere near as clean as the media has portrayed.

Edit: I listened to a podcast he was on speaking about the merger. Let me tell you, he knows his stuff.
This was the “easy” deal. Fox/DIS or Fox/CMSA are much harder.

EDIT: Is this the podcast you were referring to ?

So does this sort of thing impact the approval of the ATT- TW merger?

Yeah, in that case if Comcast isn't going to get Fox, then they can overpay for that 61% of Sky (i.e. they can offer something ridiculous like $20+ billion for just that 61% of outstanding shares).

Then I think we'd see a swap of Comcast's 30% of Hulu for Disney's 39% of Sky (with a couple billion in cash added to Comcast's 30% Hulu stake to make the trade equal).

A swap like that would be beneficial to both.

I don’t analyze potential stock prices/outcomes...it’s basically unfettered riverboat gambling since the 90’s...

...but I always thought this might have been the objective/endgame in the first place.

Right. To add to this.

Hulu is valued between 8.7 and 25B. 30% of that would be between 2.61 and 7.5B

https://www.hollywoodreporter.com/news/hulu-worth-25b-analyst-says-896612

Comcast has made the valuation for Sky equal to 31B. 39% of that is equal to 12.09B

Right now the market dictates that 39% of Sky is worth more than 30% of Hulu.

Just for my own curiosity, why is everyone thinking that Hulu is so important to Disney when they are essentially going to be launching their own streaming service? I get that its a platform for showing more adult content but when the ownership is shared with other companies, i can't see Disney being that bothered about it. Surely the value in Hulu for Disney is purely the amount of subscribers?

To me, Hulu and SKY are completely differentness of the spectrum?

Hulu targets a different audience. It's going into children's entertainment a bit, but by and large, it targets an older audience than the presumed "Disneyflix" will target.

FX titles would likely head to Hulu as well as the current broadcast network shows.

Expected this ruling. If it was 6-10 years ago before Netflix/Amazon Prime/Youtube/Facebook, then I think AT&T would have lost.

Huge bidding war begins now for the Fox assets.
