This will probably be overturned…but I’m not sure if they will deem it necessary beyond the start of the summer anyway?

Hopefully it just goes away…but maybe a seasonal thing?

We’ll see.

I wouldn't be surprised if it plays out something like this...
  • The CDC appeals the ruling.
  • The appeals court stays the FL decision while it is being appealed, so the mandate gets reinstated for now.
  • It gets dragged out for two weeks in appeals.
  • The May 3 deadline passes - making the appeal moot - and the mandate is not extended, or the appeals court rules in favor of the CDC who then choose to let the mandate expire May 3.
  • The mandate is now gone, but the original deadline is upheld. Both sides claim victory.

I know we're not supposed to discuss politics here, but I could see them getting it stayed pending appeal and then choose not to extend it past 5/3 so that they don't have to deal with the appeals court ultimately declaring they lacked the authority. IOW, render the issue moot by removing the mandate anyway and then no precedent is set that they have to abide by for future cases.

Only a victory for both sides if they intended to discontinue the mandate 5/3.
I never said it would be a victory for both sides of the case, just that this situation would allow both sides to spin it in such a way to claim it was a victory regardless of whether it actually was or not.
