It means they can try again to enact a similar mask mandate, if they have statutory authority and if they comply with rulemaking procedures.

This will probably be overturned…but I’m not sure if they will deem it necessary beyond the start of the summer anyway?
Hopefully it just goes away…but maybe a seasonal thing?

I flew yesterday. Mask enforcement in flight was nil. Most people masked up, but once food and drinks came, that was the end of that.
Didn’t hear any one ever asked to pull up mask.
It’s silly at this point.

I wouldn't be surprised if it plays out something like this...
- The CDC appeals the ruling.
- The appeals court stays the FL decision while it is being appealed, so the mandate gets reinstated for now.
- It gets dragged out for two weeks in appeals.
- The May 3 deadline passes - making the appeal moot - and the mandate is not extended, or the appeals court rules in favor of the CDC who then choose to let the mandate expire May 3.
- The mandate is now gone, but the original deadline is upheld. Both sides claim victory.
Struck down. Sent back to the CDC to try again if they wish, but only after following the established procedures they are bound to follow in order for an order to be deemed legally binding.

I know we're not supposed to discuss politics here, but I could see them getting it stayed pending appeal and then choose not to extend it past 5/3 so that they don't have to deal with the appeals court ultimately declaring they lacked the authority. IOW, render the issue moot by removing the mandate anyway and then no precedent is set that they have to abide by for future cases.

I never said it would be a victory for both sides of the case, just that this situation would allow both sides to spin it in such a way to claim it was a victory regardless of whether it actually was or not.

It means the mandate is tossed out unless the government gets an appeals court to stay the ruling. It also means that the CDC can try again if they really want to, but they have to follow the proper authority and rulemaking procedures which this court has held they violated.
