If she piloted her craft in front of the ferry, I'm sorry - it's her own damn fault - not Disney's. Just because you're on open water without painted lanes doesn't mean you can just freely zoom around. Though perhaps she wasn't aware that she shared the water with other traffic. Still, you need to look around you... That should be common sense.
