Victim alleging Tower of Terror is dangerous asks for a new trial

What kind of crack is this guy on? The ride has many signs. "Yeah, I didn't noticed this ride drops at all when I'm starring right at it and seeing people dropping in the shafts visible outside the building." Some people are so stupid :brick:.

Never mind the screaming falling guests, the signs, the maps, the guide books etc. Whatever happened to just asking a CM the question of "is this a thrill attraction"?

It's called the Tower of Terror not the Tower of What a Lovely View. Take some responsibility and pay attention the signage that is posted EVERYWHERE.:mad::brick:

If the attraction was truely dangerous or life endangering or what ever you want to call it, there would be more than one person involved in the lawsuit.
 
I just look at this, shake my head & laugh! This whole case is so STUPID!:brick:I'm 66 I rode on the TT when it was only ONE drop! Then last yr I got the chance to do it again,reason,MORE DROPS!! So as I got on ,I wondered,this should be interesting....end result...kinda let down!! I thought it was ...TAME! I wonder what kind of shape this guy was in to begin with,this whole thing looks to me like a con job.If ,I was him (& his lawyers)I would think DISNEY....will settle....Disney won't miss the $$$ & who knows how much I can get!! We will gamble that Disney will NOT want the publicity,nor the expensive drawn out legal proceedings...It's a WIN situation!!Not this time!!!:sohappy:

Fast? the lawsuit is 8 years old.


I didn't mean the total time between incident and trial.... I just meant from the start of the court case to this first verdict from the jury. Not much time.

Anyways... I think if he is holding a grudge for 8 years... he must not have anything else in life to look forward to. Maybe he is trying to get Disney to pay for his retirement home in "The Villages."

I had a relative that was injured at disney due to a faulty safety device.. This person was not permanently injured (VERY minor injury), and we didn't sue disney.. They did all but FORCE us to take a small cash settlement, I honestly tried to decline, but the person on the phone told me "Once it gets to me, all I can deal in is monetary compensation"... anyway.. Took the cash and used it to pay for a disney pass, or something.. it wasn't a large amount of money at all..

the point is, Disney has no problem taking care of things when they are truely at fault.. this person is a dip****.

OMG.... you used cash from Disney... and reinvested it back to them?? How horrible you fell into the trap of giving the money back to the 'Big Evil Corporation' that wears a pair of mouse ears :rolleyes:


I might have asked the guy on the phone to connect you with the person who hands out the 'Lifetime Fastpass' cards.

Simple answer to your points...

The 80 yr old man was wearing spectacles that did not allow him to read signs, and he had his hearing aid turned down, so he couldn't hear the audible warnings etc.... :rolleyes:

But what is the fun of blaming yourself for your own ignorance?

You would think the screaming that can be heard from the front of the park and the fact that you can see the elevators going up and down from the front of the attraction might be a clue that ToT is not a clone of IASW.

Maybe Mr. Darwin was just trying to thin the herd.

Don't forget that at the time he was only 68. I'd like to know what this guy did for a living where he could be so unobservant. Maybe he works for the government.

Unfortunately this is the state of the world we live in. I worked at Soarin' and all I ever heard was "Is this a ride?" or "Is it 90 minutes till it starts or 90 minute wait?" or "Do you work here?". That last one always made me laugh "No I just wear a blue suit with 'Soarin'' embroidered on it and name tag for no good reason". But some people still had the gall to fight with me on the height stick. It's a never-ending battle. Either people are mad because you are trying to be safe, or the accuse you of not being safe. Never a happy medium. People are just ignorant sometimes, and even still at my resort. "Walt Disney would be rolling over in his grave if he knew smoking was permitted here!!!" and I wanted to ask the guest if he knew what killed Walt. Sigh...'tis the path I have chosen and the cross I bear. :D

And people wonder I hate lawyers.

And in the interst of full disclosure, I am a lawyer! I am so glad Disney did not throw some money at this man to settle the case, not one dime. I wish more big corporations, small businesses and mom and pop operations would fight back against frivilous lawsusits filed by slimy lawyers just looking to make a quick buck from a quick setttlement.

Does any one on this site know why when Lawyers die that they burry them 12 ft deep instead of the normal 6 ft deep?

Because it is believed by honest people that somewhere down deep Lawyers are good!

Honestly this is the most ridiculous story about this 80 year old man and the ToT that I have ever heard. He should really be ashamed of himself. Did he think the Tower of Terror was going to be cute little bunny rabbits and move at the speed of SSE. Then what about the signs posted, the screams heard and of course seeing the open window from outside and seeing the people drop. Lastly he could have asked a cast member before he gotten on what the ride was like and opt walk to the exit and wait for his family if he thinks the ride would hurt himself. I guess common sense does not prevail here. Not to mention WDW wins the case and now has to pay again to go to re-trial. Thats bull. I hope when WDW wins the case again that WDW lawyers ask the courts to have this person pay the leagal fee's that Disney has to pay out. That just might set a precendense to help stop law suites like this.

I've herd weirder. that woman who sued Disney because they denied her excessive rides on TOT even though she claimed TOT was the one ride that eased her pain.

Is this an example of Extortion? There are warning signs everywhere...Did this guy think that the Elevators that fall were full of animatronics and where all part of the show?

I wish there was some sort of law against frivolous lawsuits like this that denied them the ability to ask for a retrial once the plaintiff loses the original trial. :mad:

... all have the right to form a retrial, it is constitutional and our right as people. Not saying I agree with it in this case, but you start drawing the line and it starts becoming an issue with human rights.. especially if you personally were wronged in a case. i know I would want every chance at getting to a company if they wronged me. That being said, I do think this guy is probably just trying to sue DW in an attempt to come to terms with the fact that he's 80, injured, and angry and wants restitution from someone or something. Unfortunately, he should have known or someone in his family should have warned him that the TOWER>>> OF>>> TERROR was indeed a .. tower... of ... oh what's that last word again... :lookaroun:lookaroun
