Music from the parks...

Hello

Sorry if this topic is a big vague! Just need some help before I do anything!

If building a Disney fan site, can we put Disney music on it? for example, the Fantasmic theme tune?

I am not up to date with copyright so want to make sure i do things correctly.

You can certainly try anything until you're caught! :)

I believe that the Fair Use law lets you use somewhere around 30 sec worth of music in any case, as long as you're not distributing it. You might even be able to use the whole thing. This is why radio stations can and do use bumper music.

Any other thoughts?

Considering there are a lot of sites out there that allow for the downloading of Disney music, you should be okay. But then again, I'm not a lawyer and I've never played one on TV :)

I just ran across this at work and was told to keep it to 15 seconds. Oh well.

Unfortunately the under 30 seconds (or 15 seconds for that matter) guideline is a myth. Any portion of copyrighted material used with out permission on a public website is a violation of the law and the rights holder could take action.

That being said, as was mentioned earlier, many MANY people have posted this music for download on their sites. It is highly probable that any enforcement would start with them, and that enforcing it against a site playing just a small snippet would probably not be worth the effort.

Also, Disney's first course of action (at least it has been with copyrighted images on websites), seems to be to send a "cease and desist" letter first.

You are probably ok. But don't get too crazy with it.
