Good grief. Everything is wrong about this video. The music is way too loud, the editing too agressive, the colours to flashy, the monorail too bling.

It is not Disney who is winning. It is Universal who is winning, by forcing Disney into imitation, by them 'Universalising' Disney. Bah! :hurl:

As I stated time and time again, if you really think Disney is going to sit on their assets and let someone else use them without pushing back, it just does not make good business sense. Or cents. Disney fired the first salvo and Universal is taking it on the chin and wimpering away like a spoiled child, I feel its just a matter of time, contract or not.

Pretty sure Universal fired the first salvo by pouring a bunch of money and updating one of the best rides on the planet, showing they have no intention of giving up the Marvel characters. An upgrade that has been celebrated by fans and theme park aficionados a like. The monorail isn't even close to par.

Heavily updated and upgraded Spider-man attraction that is a draw for people > A roving billboard

The Avengers monorail is a huge step, and I don't think people really quite understand its significance.

In my opinion, its the first step.

But Jimmy, Universal has a contract to keep the Marvel characters out of the parks...?

Well, to be honest, if Disney wants to end that contract, they have the financial means to do so, which apparently people don't want to see or understand. If Disney or not wants to spend the money, thats up to them.

But who says they have to put the characters in the parks? They just proved they don't have to, to get people to realize they have the characters.

And they could put the characters in or around the Boardwalk, Transportation and ticket center and Downtown Disney, which are high traffic, visible areas of the resort not considered in a theme park.

Iger said one of his goals was to increase the presense of Marvel characters around the Disney Parks, and in one fell swoop he did it with a monorail when people said it was not possible.



Could this be the start of something big?

I might be wrong, but I just do not think that Marvel characters or attractions in the parks makes financial sense at the moment given the legal hurdles that Disney would jump before the first shovel of dirt is turned. Disney is much more than a theme park business. If I am not mistaken, the theme park side of things provides the lowest bang for their buck right now. There would have to be good deal of legal wrangling to put the characters in the parks in WDW. Even if Disney's legal team was able to come up with a workaround they would still get sued and probably rack of a 7-8 digit legal bill in the process.

I see Disney using the Marvel brand for movies, TV, merchandise,etc long before they make a theme park presence simply because that is the low hanging fruit right now.

It's an ad for a movie, plain and simple. It is not an "attraction" at the theme park, it's an ad on their "public" transit system. Also, technically, it's not in any theme park.

And for Disney to really get Marvel, Universal would have to agree to sell them back the rights (or violate the contract, thus losing them). Universal has no intention of doing that.

It never ceases to amaze me that people see the world like this. Disday, it doesn't matter if you find it tacky - the Marvel Super Hero Island is well within the stipulations of the contract. Disney can't just declare that they have an "out" - that "out" has to be in the contract from the beginning, the rules can't be made up as you go along. For the record, Marvel Island is beloved by many theme park fans and includes what is considered by many to be the greatest theme park ride of all time - The Amazing Adventures of Spider-Man.

I could still see some legal action take place over Avengerail. If not this incident, the next will prompt something - the moment you see a character breakfast or something stupid like that (even if it's in a resort, not in a theme park), there's gonna be sparks flying.

Marvel isn't going anywhere unless Universal gets the okay. That means big, big bucks - enough to pay off the contract at a price of Universal's choosing. This means they'd likely have to pay Uni enough to deconstruct the Island and build new attractions, plus some probable bonuses due to the sheer popularity/profitability of the characters. As a shareholder, I'd wager spending THAT much money only to have to spend MORE money to actually construct something worthwhile in a Disney park is NOT a good investment. But hey, as long as we show Universal what's what!...

Then again, this is like talking to a brick wall. You guys will go on believing what you believe despite the lack of sound, legal argument backing you up. Those who have some concept of the actual legal ramifications of the Averengerail and the Uni/Disney Marvel situation will watch with continued interest.

Did anyone else notice this on the video? Read the vid description at the bottom. It says the Avenger Monorail runs through the Magic Kingdom park. But the video is clearly showing it run through Contemp and Poly. And we all know Fla's monorail only runs by MK's front entrance, not through it like at DL. Disney is definitely testing their limits with this, and someday will have Marvel inside a park. I have to give DisneyParks kudos for being brave and pushing this "through the park" thing. :sohappy::sohappy:
As long as it's classy and not distorting ambience/atmosphere. Most likely the characters/land will fit in at DHS. I cannot see Marvel being in any of the other 3 parks without being an eyesore.

This is exactly what they bought marvel for. Just think about the billions of dollars the Marvel character films have made over the years. The Avengers is going to make Disney big money in theaters and merchandise sales. As much as we get on Disney for the conditions of WDW, they are not stupid and they knew they would not be able to use Marvel Characters at WDW parks when they made the deal.

I'm pointing out a blatant flaw in your line of reasoning. You're allowed to believe whatever you'd like, but facts are facts. But then again - you point out facts in these boards that rub the "Hail Disney, kill Universal!" folks the wrong way and you're told you have anger management issues. Right. :hammer:

(predictable response from Thick's camp - FACT!: Marvel characters are now featured on Disney property so therefore Universal relinquishes all rights! :zipit:)

Also... anyone else notice that some of the people supporting Thick have very low post counts with recent join dates? Awful curious.

Two things:

Everybody understands that there is a contract regulating Marvel property rights. This is not the issue. The issue is the question how Disney views the limitations of this contract. The questions are if it seeks to try to test the limits of their rights, if it seeks to encroach on Universal's turf, what its strategy is regarding Marvel in Orlando.


The 'Thick Camp' - which doesn't exist - is made up of people arguing that Disney will try to test the legal limits of the contract not because we want Disney to. But because we think it is. Some root for Disney, some for Universal, some for neither. Some wish for, some wish against Marvel in Disney parks.

I wonder if we could ever end up with a situation where Disney pays off Universal to give up the exclusivity, but still allows them to keep what they already have?
