Monorail Wrongful Death Case Dismissed

I personally think that since the majority of us don't know all the actual details, making a judgement call on whether this is the right decision or not isn't prudent. The CMs on here know some of the information (on a variety of levels) so their opinions will probably greatly differ than those making blanket statements about a "stupid employee".

I don't know the details of this case so I don't know where the blame should fall, but I'm quite suprised this was dismissed. Could the victim's family appeal the dismissal?

However, I will say over something I noticed at disney is they were always looking way to cut staff, eliminate positions, give castmembers more responsiblities, reduce the number of people on the clock... and I think show, service and even safety can suffer as a result of that.

The case was voluntarily dismissed meaning they settled out of court. Terms of the settlement most likely will never become public knowledge.

You had to figure this was going to happen. I'm sure Disney was ready to do whatever they could in order to keep this from continuing to make headlines in the Orlando media.

Likely. Thus, the information will probably never be public record.

Although, it could have also been dismissed because of her specific charges. If the judge didn't think the current charges were valid enough to go to trial with, he could have tossed this case - but another could still arise.

Regardless, justice will be served in some format. If they settled (most likely), she'll get her grievance money and the rest of us will hopefully benefit from a monorail system that's run properly and safely. If the case was just flat out tossed, that's also "justice" - just not the most desirable solution for some of the parties involved.

Dismissed may mean that it was settled out of court! I would bet that this is the case.............with all parties signing a agreement not to release the details.

I can only hope it was a fiar agreement.

I don't know a lot about this. I have one question don't they have a radio to tell the kid who was killed that the other one was coming? Could he of evacuated the monorail?

There were SEVERAL things that went wrong, all at the same time. A lot of loopholes were discovered in monorail training and operations, which have since been fixed. There was also human error involved, which has also been addressed by way of staffing additional personnel.

There are several threads discussing the accident itself. In the interest of not having this thread turn into another finger-pointing abortion, I recommend doing a search on the monorail accident. In case you haven't noticed, things can get tense around here pretty quickly :)

We'd love to think it was because of a moral obligation, but Disney settled to save face and money.

Unfortunately, as with almost every major corporations, settlements are usually done to keep things short and out of the press. Something high profile like this would see the trial get a lot of coverage in the Florida papers, and Disney doesn't want any more bad publicity from this situation. While I know that it is no compensation for the loss of her son, I am glad that his mother and Disney came to an agreement and that the situation can finally come to a close for those involved.

It was pretty much the perfect storm (monorail style). What could go wrong... did go wrong!

You'll find lots of info if you do a search! Trust me, everyone questioned why and how this happened!

I wonder what happened to the CM who was at Perkins, when he should have been maintaining the monorail operations?

Was this standard procedure to go out to lunch whithout someone else to maintain that position?
