hey this is pretty much pointless but i had to ask

is it ok for characters in costume to call u stupid. when me and my friend went like 2 years ago some guy in a crash bandicoot outfit called us stupid cuz we werent talkin to him and since then i have never liked crash bandicoot

yup... they are actors and in character...

it is perfectly legal to call someone stupid to their face. It's only defamation of character when it's done behind their back.

And even then, no one would really call it defamation of character. I mean please... 'Stupid'? Maybe your third grade teacher would care.

Defamation of charactor can only be tried and proven if ppl would actually believe the comment, and you would suffer a loss or damages as a result.

That being said, if you have a very intellectual job, and Crash Bandicoot calls you stupid, and ppl believe him, and your reputation is damanged as a result, that would be illegal.

Maybe not. Lest we not forget that truth is always the ultimate defense. Someone can have a very intellectual job and still be considered "stupid" in one respect or another. Also, being called "stupid" is usually not sufficient. There needs to be a more specific comment, for example: "MKT is stupid because after graduating from UF he failed the Florida Bar twice." If this comment was not true but communicated under the appearance of truth, there could be issues.

With the question of a character (or any "entertainer" for that matter) delivering the speech, there is no way you would convince me or any other Judge that a reasonable person would believe the information to be true.

The People Vs. Larry Flynt has illustrated this better than any other film that I've seen.

...and yet another issue - humor. How many comedians say things about our President "behind his back" that may be untrue? Free Speech simply has a heavier hand than defamation laws. Simple cost-benefit.
