ORLANDO -- The family of a 9-year-old boy killed while riding his bike at a Walt Disney World property filed a lawsuit Tuesday against the company.
Attorneys for the family said Disney's negligent behavior caused the crash.
They claim Walt Disney World failed Chase Brubaker and caused his death by neglecting to design a road that would keep him safe from harm.
"They created a foreseeable zone of danger where they knew children and pedestrians would be," said Karen Terry, the Brubaker family's attorney.
That foreseeable zone of danger is along Big Pine Road inside Disney's Fort Wilderness Resort and Campground.
Court documents claim Brubaker was killed because the sidewalk is too close to the road, the bus wasn't properly maintained, and the bus driver didn't get adequate breaks throughout the day.
The Brubaker's lawsuit faces an uphill battle.
Disney was cleared of wrongdoing by the Florida Highway Patrol.
In the crash report, the FHP said the crash happened because the boy's bike had a flat tire that he shouldn't have been riding on.
“We have had accident reconstructionists, biomechanical engineers, and human factors experts come out to the scene and they disagree with the FHP’s finding,” Terry said.
Although the lawsuit primarily focuses on Walt Disney World, the Brubaker family is also suing the man who was driving the bus.

This really really angers me that not only are they going after WDW but the individual driver. Apparently the life of your child is worth less than some of that money you're hoping to make.

It's lawsuits like this that cause Disney to do things like put lap bars on Splash Mountain, and pointing fingers on Haunted Mansion.

It's very sad that this was predictable behavior. Back in April everyone was speculating that this would happen and sure enough here we are.

Maybe Disney should counter-sue the family for damage caused to the bus and the driver should counter-sue the family for emotional distress because the boy wasn't supervised and riding an improperly maintained bicycle... Just a thought.

I think this is more a coping mechanism in line with the denial stage of grieving. These parents are facing not just the loss of their child, but the reality of what nobody wants to stay straight out, that they sent their child out on a bike he should not have been riding in the first place. That is a lot to deal with, especially after they had already lost another child. I am much more angered at the lawyer who, seeing these grieving parents, sees an opportunity at making some cash, either through lawyer fees or a settlement with Disney, instead of helping them face the reality of the situation.

Ugh, it was already determined that it was not the bus driver's fault. But of course, the media will probably ignore this fact to make Disney look evil.

this is a very simple process. just like with michael jackson, its just a guarenteed money making scheem. although im not convinced he was wrong on at least one occasion, im doubtfull he really molested all them kids. i think its because they all knew they'd get something out of it. if you you sue for a rediculas amount of money, cause enough bad press, sooner or later the company, (or michael) will settle on a lesser amount to quiet everything and make it go away. so lets say u sue for 200 million dollers, and settle for 10 million, you still made a nice pay check.

P.S. splash mountain didnt have lap bars at one time????

The suit more than likely won't go anywhere, but maybe it will help close things out for the family, one way or another....

So the child and by extension the parents have already been proven to be at fault and they're STILL going to sue? I hope this gets thrown out fast.

If there are any charges it should be for child neglect. When I first read this story I couldn't believe that the parents would allow the child to ride the bike to begin with.

I see there is a Facebook for Chase. If I was any colder than I already am, I would send a message knowing the parents will be getting it telling them how #$%^ing ridiculous they are and to accept the fact that if there is blame to assign, they know where to assign it.

It's really easy to say all the things that have been said in this thread...until you're the one who lost their kid.

True. I can't imagine the thought of losing one of my kids.

On the other hand, I can't imagine letting my kids ride their bikes alone in an area that they're unfamiliar with.

even still, it's called taking responsibility. We've been told the facts of the case...the bus driver was not at fault, Disney was not at fault, the bike was not in a condition that the kid should have been riding it in, and the kid wasn't being supervised. No amount of money will ease the guilt or bring their son back.

The reality of this is it will not bring the child back, the money will help pay any cost of the death & burial of the child ( if they did not have insurance coverage, alot of people dont for their childern).

Then it is a point of power to say I was there enjoying life and your system took away my child no matter who's fault it is. So now they will turn into advocates for what they feel is failing systems, to in turn to cost disney more money.

I am very sorry these people have lost there child. I have not idea what pain i would feel if I lost of my childern.

We knew this day was coming, because this is what society does nowadays. I can't comment on the parents, because I could never begin to imagine what they continue to feel. However, filing lawsuits when you already have proof the other way won't bring them closure. I don't think there is any way that money could ease the pain of losing a child.
