But Big Al came back. And some crap Cast Member decided it would be fun to turn the country bears into savage creatures that run around terrorizing the streets of Frontierland. . .

I'm almost waiting for someone to step into this thread and give the legal reasoning behind this...No names mentioned of course:lol: Just Kidding!

until you've spent a day chilling with the characters, don't bash it. To this day I have permanent back injuries due to that line of work....

You might want to check with a lawyer to see if you too can still sue. Those ToD costumes were not made with the safety of CM's in mind!

I think it's horrible that they forced this man to take a job and continue to work and not give him the opportunity to quit whenever he wanted to.

If he felt the job was unsafe, QUIT.

Yeah, you pretty much know getting into being a character that it has its downsides. My boyfriend passed out as Woody one day and you don't see him whining. I'm not even sure what happened...I am sure curtains can be heavy, but seriously! If anyone knows what the Bear in the Big Blue HOuse costume is like, you'll feel more sympathy for that guy.

You've never worked on a cruise have you... you're generally locked with a contract for 'X' amount of time. You CAN quit, but there are generally repercussions for doing so.

yes you do... but you don't know how little Disney does to prevent it. They claim to do work to improve character safety, but I've never seen anything done. I wonder who ever read the pages of paperwork I've filed due to my injuries

although the amount is a bit much, am I the only one who doesn't view this lawsuit as frivolous?

I think it is frivolous, you can't tell me this guy did not try on the suit prior to the performance if he couldn't see he should not be in that position. In regards to the markers, are there any other performers complaining. And if he couldn't see a thing then what help would markers be in the first place? Finally, I have yet to meet a curtain that could be heavy enough to cause true physical harm.

I have not worked as a character and if it is a problem then maybe this lawsuit will cause some change, but from my vantage point this seems silly.

Three years after the fact? That's where I have the biggest problem. If he was hurt, he should have made an issue of it while it was fresh. Rob, how much credibility do you think you would get if you decided to sue Disney two years from now? "Loss of enjoyment of life"? It's taken him three years to figure out he's not enjoying life since he got hurt? I just don't agree with it.

Scott... you know my stance on this. My situation is considerably different. I was injured in 2001 and 2002, and to this Day, even after my dismissal from Disney, they still continue to pay for medical expenses due to their negligence. Maybe due to his contract he wasn't as lucky. Odds are, he's been in some sort of arbitration with Disney for the past 3 years and NOW it's going to court and hits the news.

Rob, I didn't know that about your situation. And good point on the possibility of arbitration; your points are valid and well-taken.

Finally, I have yet to meet a curtain that could be heavy enough to cause true physical harm.

It's probably not the curtain, but the 40 foot steel pipe that is in the bottom of the curtain. Pipes are sown into the bottom to give the curtain enough weight so it:

1) Doesn't blow all over the stage when it is in.
2) Flies staight down when being flown in.

Also, depending on the fabric, some curtains can weigh at least 300 pounds.
