I think some are giving him a little too hard of a time with this scenario. I thought it was interesting as just a possible scenario. (not very likely, but interesting to think about.)

Fun tid bit about marvel in universal according to the contract they cannot include anything new from the marvel universe into the area while they can give some rides new graphics, such as spiderman. They cant add or include anything new from the avengers franchise or anything else. Meaning overtime that area will start to become stagnant which is what Disney is hoping for. Also Disney can build upon their marvel franchise in california which I heard there might be a whole park but unless its outside of the parks over here nothing is happening at WDW

No. "News and Rumors" doesn't mean "make something up from things that happened 10 years ago, start my own false rumor and call it fact".

Maybe I'll start a thread titled "Disney To Build Fifth Gate as a Star Wars/Marvel Park". It would be just as based in fact and relevant as this thread. At some point, the line has to be drawn.

Hopefully the mods will move or lock this thread.

I was hoping that Marvel making a Guardians Of The Universe movie was Disney's attempt to get around this, but nope, they too have appeared in Avengers comics.
That's my theory, too... that movie choice just came out of left field! EVERYTHING has crossed over in the comics world, but the Guardians did have their own #1 before they appeared in any other series, I believe. That may be a line that Disney's lawyers were confortable with? If we go with the "they appeared in ______ series test", then there would be basically no characters left. It just seems to me like why bother specifying different characters and character families in the original contract if you could claim 99% of the Marvel universe just by doing Fantastic Four and Avengers?

Members of the Avengers are already present at Islands of Adventure, so the whole set of characters are there's to use in perpetuity.

Not true. As the contract states, the only characters they can use are the ones that had a presence on opening (and no, this doesn't mean they could put mural someplace with all of the characters and say that gives them rights – it had to have been a substantial presence, like a ride based on the character or a meet and greet).

It does give them exclusivity on any character that was ever an "Avenger" or included in the "Avenger Family" (which is pretty much any Marvel character) but they cannot use them unless they already have a presence in the parks. This would include The Fantastic 4, Dr. Doom, Spidey, Hulk, Thor and Captain America. I believe those are the only characters Uni can actually use.

I think this might be the one area that may not be as clear. If Universal has exclusive rights to a family of characters it just seems silly that they cannot use an as of yet unrepresented member of a represented family. The have Captain America, why can't they add the Winter Soldier? Nobody else can use the Winter Soldier.

The whole point I was trying to make in my OP is that there are things they can do to get the Marvel rights backs. I admit, the way I suggested in my OP is probably not the best way.

The only thing they can do is pony up an ungodly amount of money. Your "rumor" has zero chance of happening.

There doesn't seem to be a consensus on what they can use, only what others can't use. And they don't have to use retro designs. They updated all of the characters' costumes several years ago.

Have you read the contract? The rights to all of the Avengers family of characters are held by Universal because other members are more than "incidental" in their use. Maybe Universal cannot add some of these characters, but nobody else can use them.

There is also no stipulation regarding "retro" designs. All work must be of the highest standards and meet the guidelines set forth in Marvel's character and style guides.

Exactly. They have exclusive rights to anyone in the Avengers Family of characters east of the Mississippi. However, if they did not have a presence in the parks when the area opened, they cannot use the character – bot no one else can use them either.
