Wrongful Death Lawsuit and Disney's Scary Attempt

Disney didn’t just abandon this argument because of bad PR. They abandoned it because they were going to lose (on that issue, nobody knows enough to be sure on substantive liability).

Wrongful Death Lawsuit and Disney's Scary Attempt

It absolutely was a stupid legal argument. Signing up for (and cancelling after the trial period) D+ 5 years ago doesn’t give Disney a lifetime get out of court free card. The argument was incredibly stupid. They were going to lose, would probably get some very unfavorable precedent on just how...

Wrongful Death Lawsuit and Disney's Scary Attempt

Also, for those saying that the lawsuit references the website so therefore the TOS for D+ apply, no MDE account is required to view the Raglan Road menu and allergy info, so it doesn't make sense that the TOS from creating an account would apply to information that doesn't even require the...

Wrongful Death Lawsuit and Disney's Scary Attempt

Arbitration is a sham that is used by corporations to avoid liability for their actions. If arbiters started handing out million dollar arbitration awards companies would stop using them and the arbiter would go out of business.

Wrongful Death Lawsuit and Disney's Scary Attempt

Arbitration is a death sentence for lawsuits. There's a reason corporations try to impose it wherever they can.

Wrongful Death Lawsuit and Disney's Scary Attempt

I'm a lawyer and I view both of those arguments as unconscionable. Had she been killed somehow by Disney+ (maybe an epileptic seizure while watching or something) or while dining at Epcot (or pursuant to a dining package purchased on the website), these arguments would at least have some merit...

Rumor Hall of Presidents Replaced by Muppets American History Show???

This isn’t about kowtowing to anybody about the Founding Fathers. The divisiveness they’d be trying to eliminate has to do with more modern presidents. They’d rather not have crowds yelling let’s go Brandon at Biden or booing Trump. Having a lighthearted muppet interpretation of American history...

News Reedy Creek Improvement District and the Central Florida Tourism Oversight District

Can, doesn’t mean they will. Or have even put such a bill in the pipeline. Orange and Osceola are blue counties, so they may well not be in any hurry to do so and they may allow that tax bomb to hit for not voting the “right” way.

News Reedy Creek Improvement District and the Central Florida Tourism Oversight District

Not just pushed for. The Supreme Court has already ruled that corporations legally are people and that the first amendment applies to them in the Citizens United ruling. Political speech is the most protected form of speech and DeSantis and Florida legislators keep giving Disney exhibits for...

Lightning Lane at Walt Disney World

So they’ve made it such that staying on property is essentially a prerequisite to ride ROTR and Rat.

Lightning Lane at Walt Disney World

Boarding groups and virtual queues were developed for the same reason as anything else: $$$$. With a virtual queue from the beginning, the building doesn’t have to be as large, so save on construction costs. Additionally, if you’re physically waiting in line, you aren’t spending money at shops...

A physician’s thoughts after spending 16 nights at Universal and Disney

They may not “all” have the same opinion, but the proportions of the range of their opinions is not the same as the general public, and their basis for their opinion is more informed than the people who watched a YouTube video. I appreciate the physician’s perspective and self identification...

    Retroland As A Fifth Gate...Potential?

I don’t think we need a 5th gate at WDW so much as a 3rd US resort (or a Canadian resort) to ease some of the crowding (during “normal” times) at WDW.

    wearing face masks?

Walking alone on the streets or waiting alone at a bus stop are not static situations. You can encounter people at any time, and digging out a mask at that point is too late, especially boarding a bus. Don’t be that jerk who is standing there with your mask off and then makes the bus wait for...

    wearing face masks?

I’ve dug plenty deep. I work in this space. HCQ is fool’s gold. Like I said, remdesivir is the best we have currently, but it’s nowhere near good enough.

As of July 27th, no outbreaks have been associated with the parks. Surprise?

I’m not terribly surprised for a number of reasons. 1. Disney has only been open for a few days. Universal doesn’t draw enough attention for people to figure out if there’s an outbreak. People forget that SeaWorld even exists. 2. Crowds have been pretty small, allowing for more effective...

    wearing face masks?

HCQ is not an effective therapeutic, and in many instances the harm it has caused has been worse than any perceived benefit. Basically every peer reviewed study has proven this. Remdesivir is a better than nothing therapeutic but is far from a panacea.
