I injury at Raglan Road

I was at Raglan Road on July 18. I was sitting on the bar stool so I could see the dancers better. Unfortunately, when I turned around to see them, my foot slipped on the floor as I stepped down to stand. I fell. Paramedics came and told my son to put me in the car and take me to the emergency room. When I screamed out in pain, paramedics were recalled by the Disney officer and I was transported to ORMC. My c1 neck vertebra was broken. Who do I report this to at Disney? The Raglan Road mgr called my son the next day to see how I was, but I have not heard from anyone at WDW. I called guest services and they did not have any record of an incident that evening. I looked at some website that said I should file a report, but where does it go? No, I have not contacted a lawyer.

Did you contact Disney security to see if they had a record of it ? Does Raglan Road have a record of the event? Without any documentation/verification, it's sadly in the realm of hearsay.

I am sorry to hear of your injury and hope you feel better soon.

Can I ask why you wish to report the incident? From your description of what happened, it seems to have been a freak accident rather than anyone or anything’s fault. Sorry if I’ve misunderstood.

I would think too much time has lapsed between your fall and now…if you have the original paperwork from the ER, that MIGHT work in your favor, but the only way to know would be to consult a pro.

Florida statute of limitations for personal injury due to alleged negligence is 4 years. Otherwise, it's 2 years -- so it's still well within the required filing time.

I would guess that it is because the paramedic miss diagnosed the extent of the injury and thinking it was only minor told his son to get him to the car and go to the hospital to check it out. It's not an accident fault, it is a paramedic error or a communication problem.

Perhaps you could answer my earlier question. Why would anyone want to file such a a report in this instance? I may be missing something obvious.

There is not enough information to properly answer your question. If it was an unlucky series of events - that's one thing. If there is anything that could be considered negligent on the part of Raglan (which I see no mention of in the OP) that's different.

We are a very litigious society. People will sue because their coffee was too hot.
The OP stated very clearly that they slipped and fell, without indicating any sort of outside factor that may have caused the accident. That’s why I’m genuinely puzzled by the idea of needing to report what happened, unless it’s because of the paramedics’ initial (bad?) advice for the OP’s son to drive them to an emergency room.

You should always file an incident report so there is a record of the incident as you saw it. This is weather you are planning litigation or not. Just like a car accident. You may not need to call the police to the accident site, but should always file one online so there is a record. Never know when someone will come after you for whatever reason. It's a CYA society.

I definitely see why this makes sense for something like a car accident, but the incident described (if I’ve understood it correctly) isn’t the sort of thing I’d ever think to report. Then again, I am British and (despite having lived in the US for years) may simply not be familiar with how such falls are treated here.

Only just saw this. Yes, this makes more sense to me (I suggested the same thing in one of later posts).

I agree for the most part. But this society is sue happy. Always best to cover your you know what.

I wasn't there. You weren't either. Was the floor freshly mopped? Was there an obstacle that caused the foot to slip? Was the individual bumped?

Point is - we're not going to gather a lot of information using six lines of a post where somebody states "I slipped. I fell. The paramedics came. I had a broken vertebra."

I tend to lean toward unfortunate accident rather than any negligence on Raglan's part based on the information given. However, if the individual has omitted certain facts that lend themselves to any potential culpability on Raglan's part (which again I don't see based on what has been presented) - then yes, they should file a report.

Disney does not own or operate Raglan Road. If you haven’t contacted the restaurant to file an injury report, that’s where you should start.
