Anything that goes wrong as a result, or anything that someone can passably claim went wrong as a result, blows back on the hotel.
Housekeepers, at least when I was one, were allowed (with leadership approval of course) to take any unopened snacks or sodas home with them. Unopened sundries are left in the room and reused. Items like clothing, stuffed animals, jewelry are supposed to be taken to a manager and logged in the lost/found system.
Not saying it would happen at Disney ... but I'd be awfully hesitant to take some food item home or other thing you could use that was left behind by a stranger because of the off chance that someone would taint the product. There are crazies out there and who knows what they could slip into a package and reseal so you wouldnt know it was tampered with. Todays a different era where anything could happen, even at Disney.

OK, let me try. You have read the news, you know the evil that exists in the world. Even a sealed soft drink is not safe from being a threat in a place like WDW. So, I would guess that some of the staff will be brave enough (I know I would) to just use it for themselves with a blatant display of a lack of paranoia. However, Disney might have rules about it and it is kept in lost and found for a period of time and then dispersed out to whomever was first in line. Imagine the effort that goes into sanitizing every single object that people get within 3 feet of and the idea of drinking someone else's drink would drive a germaphobic into a premature grave.
Precisely. 90% of the discussions with legal, these days, are not about the potential liability of what we're offering, but rather is about the potential liability of how what we offer can be abused, misused, or otherwise exploited beyond the bounds.
