Here's why I think Disney will eventually get back Marvel theme park rights. Notice how they have already begun he system acquisation of rights. They are putting Humpty Dumpty back together again, one piece at a time and systematically, stating with film rights, character by character, studio by studio. From Wikipedia:
"In June 2010, Marvel Entertainment set up a television division within Marvel Studios, headed up by Jeph Loeb as Executive Vice President, under which Marvel Animation will be operated. On October 18, Disney bought the distribution rights for The Avengers and Iron Man 3 from Paramount Pictures. Disney, however, purchased the distribution rights before Marvel's "5 picture deal" with Paramount was complete, thus Paramount's logo was for both films instead of the Disney logo.

Fox had approached Marvel about extending the deadline and becoming a co-financier for the film, but was rebuffed. On October 10, 2012, the Daredevil film rights reverted to Marvel Studios, leaving the X-Men, Fantastic Four, Spider-Man, and Ghost Rider film rights as the only franchises still left at other studios. The only non-Disney studios that Marvel currently still has contracts to are 20th Century Fox, Columbia Pictures and Universal Pictures.
