Restaurants (TS at least) are definitely more spaced out than usual. I wouldn't say 35%, probably 50-75% depending on the restaurant. They pretty much are not controlling crowds at QS locations, though yesterday I ate at Pinocchio's at 2 pm and there was no one around me.

Parks are nowhere near capacity right now, but that's not because of Disney controlling crowds.

I believe the Fire Marshall may set the maximum number of people that can be inside a building/ room, but the parks have tons of room outside of all its buildings.
The maximum number of occupants is largely determined by the architect. The building and fire codes have standards based on use but a building can typically exceed those limits so long as the design is able to handle that many people.

…because Florida doesn’t bother to have rules

luckily it doesn’t have a lot of fires as well
