Magazine Worthy Photos Needed

Hey! I am getting ready to start a Magazine...read post in the Chit Chat Forum...and I need photos to use! I will need photos of various Disneyland things (scenery, rides, shows, characters, etc.), Walt Disney World things (EPCOT, Magic Kingdom, Disney Studios, Animal Kingdom, Downtown Disney, hotels, water parks, etc., and Disneyland Hong Kong Construction photos. Disneyland Paris and Tokyo Disneyland pictures might be useful sometime (they would go in our Photo Archive to be used later). We will need your real first and last name and (if you know it) the date the photo was taken with each picture submitted.

Anyone that wants to submit a photo:
The magazine will be offered free of charge to EVERYONE (starting off). We may, later, start having to charge a subscription fee (probably starting at $3.00 a year). Any photos submitted will be given the credit that is due in the magazine (when they are used). We will offer you a free subscription for as long as you want. Even if we start charging a subscription fee, you will keep a FREE account as long as you have given at least three pictures. These pictures can be anything from any Disney park. PLEASE TRY TO REFRAIN FROM "PERSONAL" PICTURES. THESE ARE PICTURES WITH YOU, A FRIEND, OR ETC. STANDING RIGHT IN THE MIDDLE BLOCKING THE MAIN SUBJECT MATTER.

Make me an offer, draw up a contract. I need to know approximate circulation, is this going to be web-only or in any sort of physical form, and exactly what will be done with the photos, as well if this is a 'per-photo' basis or if you want a contract rate.

OK...uh.... I will give you no money but a free subscription and there is no contract! All given respect and all due credit will be given in the magazine right next to the photo (in the caption) Thanks Alot!:D

I'm sorry but i just dont give away my photos to magazines, internet-based or not. Its bad business.

To answer the internet of physical form question: It will be a REAL, physical, touchable, paper magazine.

The photos will be used to go along with articles. However, they will be stored on disc for later use. For instance, say we get a picture of the Pirates of the Caribbean facade at Disneyland and for two years, we dont have a Pirates of the Caribbean article. That photo will be stored on a CD so that, after those two years, we can put it in the article to show the ride's facade.

No contracts! I don't like them!

Also, I forgot to mention...anyone that wants to publicise thier buisness can give me a logo, banner, or ad that they want in the magazine and I will put it in right in there, somewhere!

Sorry, i wont work without a contract, and neither will most photographers that produce magazine quality work. It's a business, plain and simple.

I wish you luck, but you should do some more research.

Alright, let me break it down, financially.

D1X 5.47 megapixel Digital camera - $3000.
512 CF memory card - $150.
24-85mm f/2.8-4 lens - $500.
Dell Laptop Computer - $1000.
1 day admission to WDW - $55.
1 Night at Value resort - $79.
Airfare, round trip - $189 or by Car, 37.5 cents per mile (Federal goverment standard reimbursement, by 900 mile drive)
2 Counter Service Meals at WDW - $20.

Thats almost $5000 dollars in overall expenses. Take away the basic equipment, thats $345 in expenses (for one day) before i see any hint of profit.

Thats why photographers dont just give away their stuff.

Austin... you may be a bit over your head here. Try packing your sites with enough content to make it worthwhile to bring it to publication... or consolidating your sites into 1 large site with enough content to make a publication worthwhile.

Second, by using Disney items in a printed manner, you run the risk of the Disney Gestapo getting in on you.

Try something low budget and text based... start a subscriber base, then use some of your OWN content (ie pictures, graphics).. and when it's feasible, THEN ask for photographers.

Even though, I don't charge nearly as much as Dave... you still can't afford me.

If you let me brand my photos with a nice fat Copyright ill give you as many as needed. Credited for my work would be a must.

I still suggest that you do all agreements on paper or via email just for good business sense. That way all parties involved are covered and know exactly what theyre getting, even if its just a simple agreement as 'for credit'.

However..... Austin, i'll give you the same warning the US Copyright office gave me. A picture of a copyrighted building, character, etc, (IE everything at disney) cannot be sold, reporduced, or a profit made off of (published in a context other than the fair use provision of the copyright act) without the holder of these rights signing off on it. They copyright office told me that disney is one of their biggest PITA's, mainly because they fiercly defend their copyrights/trademarks like a lion defending a fresh kill.

Here's an example - Rob takes a picture of mickey in front of the castle. Sure, he can post it on his web page, however if he tries to sell that picture to me for me to put on display or in a book, we're infringing on Disney's rights as the copyright holder to Mickey as well as the castle. They would have to sign off on it despite the fact that rob would hold the righst to the image as a whole.

Like i said, i wish you luck, just becareful with all that you do.

I have some excellent photos of Disneyland. The best of them include the Matterhorn, a statue of the White Rabbit in the loading area for Alice In Wonderland, Sleeping Beauty Castle, It's a Small World, Toon Town, and the Indian Village on the Rivers of America.

AGREEMENT:
I agree that any work that I submit is not in any way owned by the InfoDisney Magazine. All the work submitted retains my ownership, but is given to InfoDisney Magazine to use free of charge. If InfoDisney Magazine tries to claim ownership to my work I have all rights to retract it from them. However, because they are a non-profit organization, I will not sue over the issue. I also agree that if the company does not publish the credit due to me for my works, I will contact them and they must publish the correction in the next issue.

I'm gonna still politely decline. I will however rewrite your contract into proper 'legalese'
