Late night, About 15 minutes before closing on our last night staying at the Polynesian (We live in orlando so we did not have a flight back the next day.. we went parasailing and to magic kingdom the next day and got home around 10 pm..) We were at Epcot and we did Test track Which I got the middle seat with no shoulder strap and is also extremely rough. I got off with a headache and bad back pain. My friend wanted to go again and when we got off it was 5 minutes before closing and there was no line so they let him go again while I went to the Post show area and sat in one of the comfortable cars (I would usually never pass up a chance to ride Test track again with no wait). And believe me.. I am not old infact i am in good shape and I am 13 years old... It got worse as we left the park And it looked pretty crouded at the Monorail. Myself, and My friend (14) were alone at the parks so I asked a security gaurd to help me make sure I could get a seat on the next monorail as I was in serious pain. When we got back to our room I was almost crying in pain and my mom used to be a masseuse so she put some hot wet towels on my back and did her thing while she called the Polynesian main building and talked to a few people who were trying to get me on an ambulance to the hospital (It was bad but who know's how long I'd be there.. dont want to ruin the vacation). Anyhow, Between the hot towels and tylonol I got better after about 2 hours. I did some swimming to relax my back and went to bed (It was about 2 am by this time..) It reminds me... Its nearly 3 am, what am I doing? If I want to wake up tomorrow I better get to bed:sohappy:

Just waiting for August 15th when I can go back to WDW :sohappy:,

broken ankle...?

Broken ankle? Sheesh, that's bad.

1) Do not sign anything for the Disney company.

2) Do not accept anything from the Disney company (such as additional park tickets, etc.) They may very well try to argue that by doing so you accepted compensation for your injury. Any doctor will tell you that from now on it will be much easier for you to break that ankle again and it will never heal to 100% of its original condition. Park tickets do NOT compensate for this.

3) Do not contact Disney yourself regarding this. Retain an attorney and that attorney will handle all further communications with the company. Disney loves to play "he said she said" games with lay people who try to resolve these complex matters themselves.

4) Act soon. The applicable statute of limitations says that you have (most likely) 2 years from the time of the injury (or the time that you learned of the injury, which in this case was simultaneous) during which to file your complaint with the court. Once that time period has passed you will be barred from filing any complaint regarding this injury.

even then, you still only have a 4% chance of winning a case against Disney. Most time when disney is sued, they settle out of court... and if you do sue, you will more than likely lose

:( MKT Sorry to hear you hurt your ankle. I too, did the same thing. I was walking down Main street at MK at park closing, and twisted my ankle on the tram track. I then fell and hit my knee and hand on the curb, video camera went flying an I lay on the ground all in an instant. I limped away, with blood and a big bruise on my hand and knee, very embarrassed. (sp?)

I was just walking and then found myself on the ground in front of the Emporium. I ducked into the store to hide out for a while and then hobbled to the bus to return to the hotel to sit with ice for what seemed forever---- Owwwwww ( I was on a trip by myself, this is a time when it would have been good to have someone with you-- except for the ?? you did what??)

I still have a problem with my foot. Should have stayed off of my foot and knee but you can not see/do much from your room when at Disney?? hummmmm. I told a CM about it the next day and they looked at my injuries and said I should have reported it but--- Oh well- It was like a bad dream !!!! :lookaroun  I wonder how many times this happens, on those tracks on main street? :lookaroun

Hmmmm......those tracks in the MK sure are dangerous! Sounds exactly like what happened to my DS! He got his foot stuck in the track and slammed down on the ground, got a big gash down his forehead. 7 months later he still has a red scar and still tells people how he got it.

I don't understand why they don't use those rubber things, that they use to protect their parade floats, in the tracks all the time. That day we went the horse trolley wasn't even running. It's bothersome to think that Disney is more concerned with the floats than the guests.

My DD hurt her wrist last year-it wasn't ride related, though. My DD and I were holding hands walking up the ramp to leave The Land and a group of teenagers ran past us and I was knocked off balance. In trying to right myself, I jerked her hand and I heard a pop and she started crying and favoring that one hand-we couldn;t even touch it. We went to first aid and they directed us to the off site med center. We went, and by the time we got to see a dr she was fine. So they suggetsed just giving her tylenol and resting the rest of the day, which we did. And the rest of the trip whenever she would see anyone running she would yell at them "Don't run!!!" hehe

They obviously don't want the floats to get enjerd.

Just a thought - does anyone think that the spelling in the original post is a put on, or is this evidence of a major problem?

Thanks for this. I was looking for a kind way to say something, but couldn't, so I was keeping my mouth shut.

Someone's gotta say it! As a teacher, it just reaffirms my belief that more money needs to go into edu-ma-cation.

If I was severely injured like the person earlier in this post, I would feel wronged. I would at least write letters and try and get something. My first trip to Disney World wasn't that great, and my father wrote letters until finally they gave him three nights free at the Contemporary. As a result of those three nights free, we came back and they treated us very well the next time. And, as they say, the rest is history.
