Why not? Jist be prepared for being measured a lot and possibly turned away if he is right at 40".

Make sure that he's sat with somebody who can hold him and support him, especially down the final drop
Yeah I'm gonna have him held down pretty tight!
That's my main concern, the final drop.

If he meets the height requirement, wants to go, and will have a parent beside him when riding, there's no safety reason why he can't ride.
I would suggest, however, showing him the "big drop" on Youtube, and letting him decide if he thinks that looks like fun, or not. (Plus he's less apt to be scared on the attraction, if he feels he's already seen what's coming). Shown here around 6:50 -

My oldest was 3 when he went on it for the first time and didn't like it and won't go on it. With that said he has been on many of the roller coasters at wdw and is excited to go on the new ones he is now tall enough to go on. He is 6 now. But still won't go on splash. His brother who is 3 this year does want to go on splash mountain and tower of terror though! We are going in May!
