The Court Minutes for Disney continuance motion are online now but they don’t really tell us anything new. (I don’t know how common ex parte discovery motions are, so I can’t say whether there’s any significance to her mention of them.)

After some googling I think RCID did contract out the garage staffing. (I found a guy on LinkedIn that says he’s the parking manager for “contracted employees”.)

The current pre-trial motions or the final dispositions? The federal case is in the middle of Motions to Dismiss filed by the state & district defendants, which seem to be fully briefed. I can’t remember whether the judge has the option to rule based on the written briefs or schedule a day for...

Seems like the details relating to the imminent layoffs of those employees should be properly laid out in the materials, along with a cost comparison and any other rationales for contracting out.

Does anyone know whether the parking garages have been staffed by district employees until now? The materials I’ve managed to skim so far make me think they the district does have 43+staff who do what what they’re contracting out to Lanier. The attached emails talk about Lanier possibly hiring...

Sorry, I hadn’t thought of the manned gates and that’s a good point. Implied consent is negated for sites with manned gates. In practice, any type of driver dropping off a hotel guest is treated the same unless Disney has previously instructed staff to turn away particular types of drivers. I...

The law relating to ride shares doesn’t address where vehicles can enter. The reference to municipalities basically says that state law will govern this type of business and municipalities won’t. I know nothing about trespass law in Florida specifically, but the common law generally recognizes...

Agreed. It’s also in conflict with their own rules. https://www.rcid.org/document/4-19-23-bos-package/

Replies have been filed in Federal court re. the defendants’ Motion to Dismiss. I haven’t read them yet but here are the links: State: https://storage.courtlistener.com/recap/gov.uscourts.flnd.463456/gov.uscourts.flnd.463456.108.0.pdf District...

I get that the RCID - Disney relationship can seem inappropriate on first impression, but I really don't see anything that's even arguably shady here. Re. RCES, the new board paid outside consultants a lot of money to find fault there, and they were visibly disappointed when none was found. I...

The district has filed a new notice to hear the motion for summary judgement on March 12 at 2 pm. Disney filed a letter to the judge with a draft order to reflect her ruling yesterday, which I assume will be publicly visible after she signs it.

BTW: the district was supposed to receive a draft of their pricey law professor’s report last week.

Not that I’ve seen. The court website has been updated to show the hearing was set for today but there’s no further information so far.

I get it 🙂. I think sometimes we have people ‘disagreeing’ here because we’re really discussing different things: - whether Disney is entitled to trespass them vs. - whether you agree or disagree with their decision to trespass them (and/or how they did it) I think(?) everyone here is in...

And it’s interesting that 2 of them mention speaking to Disney “employees” who confirmed they could operate on park property. In other words, at some point they did turn their minds to whether they were allowed to operate in the parks, but then relied on the opinion(s) of unnamed employees...

They continue to argue that their motion for summary judgment relies on undisputed facts but that simply isn’t true. They’re even claiming that Disney shouldn’t be able to depose the people who signed the declarations that contain these “undisputed” facts before the motion is heard?? But what...

    Trespassing third parties

We can acknowledge that some people abuse the DAS system without blaming the DAS system itself. It’s an important system that addresses the genuine needs of many guests. But any system can be abused and there will always be people out there who will abuse it. It would be impossible for Disney to...
