A Los Angeles judge Tuesday rejected prominent findings by a court-appointed auditor that appeared to favor the Walt Disney Co. in a lawsuit brought against it by Stephen Slesinger, Inc., which licenses the Winnie the Pooh characters. Reporting on the ruling under the headline "Pooh Hits the Fan," Daily Variety commented today (Wednesday) that the decision by Judge Ernest Hiroshige represented "a potential multimillion-dollar setback" to Disney. Besides castigating the auditor, Hiroshige said that he will assume that 12.5 percent of Disney's merchandise sales since 1983 came from Pooh products. It has yet to be decided whether sales of videocassettes and computer games will be taken into consideration in determining which merchandise falls under the rights agreement.
