It was on the news here a few weeks ago. Some guy shot his amateur movie in Disney World without their permission. I wondered if the people who got put into a movie without their knowledge could ask him for money.

I am not a property or entertainment lawyer. I know so little that I wouldn't even know what kind of lawyer they would seek, lol.

All I know is some guy made an amateur movie at WDW and regular people like you and I got filmed...at least that's what they said on the local news.

I think that if he hadn't made his little film in WDW, nobody would ever hear about it. I don't think it's a regular, good kind of movie.

I think the key comes down to whether or not the filmmaker can/does profit in anyway from the film. If it was just a home movie for fun and posted to YouTube that'd be one thing but if this is played at a film festival, and if any admission is charged of some sort... I think it opens it up to a whole lotta law suit potentials. As you mentioned, the folks that were essentially unpaid extras (the guests) and Disney didn't give them rights to film on their private property. It looks... interesting... but depending on the legal red tape they went through, they could've landed themselves a lot more than instant recognition for their film because of it's Disney association. Interesting to say the list.

From a legal standpoint, this actually matters very little, especially in a case like this where the "value" lost by Disney by the dilution of their trademark is wholly separate from the economic viability of a film such as this one.

From the law's perspective, there isn't much of a difference between a guy that sells $5 bootlegs of Monsters University at a gas station and someone who prints out a bunch of DVDs of the same movie and hands them out for free. The question is whether the IP holder has been damaged through loss of profits or dilution of trademark or whatever the theory of the case is, not what the IP violator gained by violating.

...not that I think Disney necessarily has a particularly strong suit for any sort of legal IP action here, especially without having seen the film in question.

Just showed my husband... the more I watch the trailer the more I can't help but think I will have to find a copy of that somewhere/somehow just to see. Unfortunately thus is the vicious cycle of "supporting" something I may not necessarily agree with but you gotta admit, the idea of a horror film set at WDW, and the potential for a connection between the "magic" and "imagination" of the place being not so innocent... well, if it wasn't about my favorite place on earth and could potentially scar me for life, it's a great idea. LOL!!

I totally agree! The kids eyes in the preview while on It's A Small World gave me the chills. I think it looks interesting for sure.
