Question about Disney Copyright

I was searching online over a question I have about Disney Copyright. So I thought I might post it here. It concerns the selling of disney merchandise wether it be characters or phrases without consent from the Disney Company.

There's an online store that belongs to a mexican actress named Anahi Puente Portilla, where she sells clothes, accessories, etc. One of the articles she sells is a shirt which has "I believe in Fairies" written in huge letters on the front that is taken from Disney's animated film Peter Pan. Anahi doesn't state anywhere in the site that she has consent from the Disney company to sell this article of clothing.

Can she sell that article of clothing without consent? I heard Disney is very strict with copyright laws, so I was wondering about that. It doesn't seem right to me that she wants to make money out of something that isn't hers. She's also used the image of "Tinkerbell" for the merchandise she tries to sell.

This is the picture of the shirt I'm talking about as it appears in her online site:

Anahi has a store that is located in Mexico which is the reason her online store was created. This pic is at her store, notice in the background I circled one of purses she sells with the image of Tinkerbell:

Anahi is the girl in the picture.

What do you think? Is there anyway to let the walt disney company know about this?

Anahi's Online Store:

Anahi already has a history for selling things without copyright consent. She was and is still using a phrase from a soap opera in argentina called "Rebelde Way". The creator of the soap opera forbid her to use that phrase without her consent, but with Anahi's "I don't care till I'm sued" nature she has not removed the shirts with those phrases from her store, same thing she's doing with Disney. What bothers me is that she thinks she can get away with it and bypass the copyright laws, selling any merchandise with phrases, designs and characters that aren't hers. She tells everyone she designs everything in the store, insinuating she's the creator of everything including disney characters and such.

Any comments on this will be really appreciated.

Thanks

why do you care so much? what's your interest here? I'm sure Disney can find this information on its own.

but anyway...

it's been awhile since I studied the laws on intellectual property, but...

I don't think Disney owns a copyright on the phrase "I believe in fairies", I don't think disney could get a copyright on such a commonly-used phrase, and I didn't see any image on that shirt that contains copyrighted material.

I also didn't see anythhing on the website that containted material which is, or could be, copyrighted by Disney.

I see a site that's devoted to "fairies" not to Disney merchandise.

yes, in the photo from the shop there's a picture of a tote bag with a disney character on it. I don't see that she's offering it for sale, but even if she is, how do you know that she didn't purchase it from Disney or that she doesn't have a licensing agreement with disney?

in short, what is your beef with this merchant?
