I need advice

I know they are some lawyers or paralegals that frequent this board so here is my question...

My parents were in a head on collision and the kid (20 something) that hit them crossed the center line and he was pulling out of a drive and hit my parents head on. Thankfully they are ok, banged up but still in the hospital. My question is how do I find out if that kid was texting when he hit my parents? We are talking about pursuing legal action. My parents truck is totaled and they have no other vehicle. I don't have the police report yet. I am going to call about it this morning. Thanks for any advice you can give me.

Call a lawyer from your state. These laws, according to my lawyer father who unfortunately had to deal with this for me about a year ago (hit and run accident), vary based on the state. My guess is that the police can obtain a warrant for the cell phone/records and determine whether or not the driver was texting. But you'll want to call a lawyer so you can take it to court and get money to help pay the medical bills, pain and suffering, etc. And a good lawyer will help you through this difficult time, answering all your questions. Trust me, you don't want to be dealing with this without the help of a lawyer.
