It's too similar... I'd suggest maybe make the mouse ears a bit bigger and have them fall outside of the D.

You might get away with a fair use claim as it is, but I'd rather not risk it.

It's a low resolution image, that isn't easily replaceable with a comparable public domain image. Also, without further evaluation of your site, using criteria such as the free .tk domain, it appears to be used in a noncommercial setting.

Bear in mind that I am not an attorney, but rather a person who makes their living from their intellectual property, and as a result has 2 very good IP attorneys on retainer.

Fair Use is an exception to copyright laws that allows you to use a copyrighted image to make a point. For example the Mickey ears are very much a Disney copyrighted icon, however if lets say a televised newscast was running a story on something Disney they might put up a graphic with a Disney Mickey head logo to help illustrate the company they are talking about. They wouldn't need permission to use it since they are using it as a reference to talk about Disney.

With that being said most people stay away from using the exact proportions of the Mickey logo, this seems to be one of the things Disney pays a little more attention to. if you put something else in the D I think you would be fine.
